B. The Northwest Neighborhood Association must give notice <br /> to the City prior to any use of paid labor at Drew Nielsen <br /> Park. All workers and laborers who are paid for work at Drew <br /> Nielsen Park must be paid an amount not less than the <br /> prevailing rate of wages established for each trade or <br /> occupation as established by the Washington Department of <br /> Labor and Industries, in accordance with Chapter 39.12 RCW <br /> (Prevailing Wages). This will require filings (intents and <br /> affidavits) with the Washington Department of Labor and <br /> Industries. The City may also require each worker and laborer <br /> to sign a Waiver and Release on forms provided by the City. <br /> 5, Contractors. Any contractor or subcontractor used for work at Drew <br /> Nielsen Park must: <br /> A. Be pre-approved by the City in the City's sole discretion. The <br /> City may require a contractor/subcontractor to sign a Waiver <br /> and Release on forms provided by the City as part of such <br /> approval. <br /> B. Prior to any work, submit evidence of insurance to the City (with <br /> the City named as an additional insured) acceptable to the <br /> City's Risk Manager. <br /> C. Pay all workers, laborers, or mechanics employed in the <br /> performance of any part of such work an amount not less than <br /> the prevailing rate of wages established for each trade or <br /> occupation as established by the Washington Department of <br /> Labor and Industries, in accordance with Chapter 39.12 RCW <br /> (Prevailing Wages). <br /> 6. Modifications. Modifications to this MOU may be necessary or in the <br /> interest of the City. Modifications may only be made by mutual <br /> written agreement between the parties or unilaterally in writing by the <br /> City. <br /> 7. Contact Persons.
