e to the health officer for approval before work is begun. In the case of milk plants signed approval shall be obtained from the health officer. Section 14. NOTIFICATION OF DISEASE. Notice shall oe sent to the health officer immediately by any producer or distribu- tor of milk or milk products upon whose aairy farm or in whose milk plant any infectious, contagious or communicaole disease occurs. Section 15: PROCEL W E 'a+HEN INFECTION SUSPECTED. When suspicion arises as to the possibility of transmission of infection from any person concerned with the handling of milk or milk prod- ucts, the health officer is authorized to require any or all of the following measures ; (1) The immediate exclusion of that person from milk handling, (2) The immediate exclusion of the milk supply concerned from distribution and use, (3) Adequate medical and bacteriological examination of the person, of his associates and of his and their body discharges. Section 16. ICE C1LAT',' - DEFINITION AND STANDARD CuN'PENT. The term "ice cream" shall be held and construed, to mean and include frozen products made from the combination of milk fat, milk solids it and sugars with or without harmless coloring ana flavor matter { and pure wholesome fruits, and with or without the addition of pure geletin or vegetable gums. { { It shall be unlawful for any person, firm, association or corporation to sell or offer for sale any products known as ice cream as hereinabove described within the city limits of the City of Everett which shall contain less than ten per cent of milk fats, and which shall contain not less than ten (10 0) per cent of milk fats and not less than twenty (2O, ) per cent milk fats and milk soli other than milk fats, combined. Section 17. ENFORCEMENT INTE RPRETATIuN. This ordinance shall be enforced by the health officer in accordance with the interpretations thereof contained in the 1939 edition of the United f States Public Health Service Milk Ordinance and Code, pages 21 to 136 thereof, as shown in three copies of the publication on file in the Clerk' s office of the City of Everett under Clerk' s file No. N, . 1 Section 18. PENALTY. Any person failing to comply with i or violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished4 by a fine in a sum not exceeding Three Hundred (y�300.00) Dollars or by imprisonment in the City Jail for a term not exceeding ninety (90) days, or by both such fine ana imprisonment. Section 19. REPEAL. That Ordinance No. 2440, entitled: "AN ORDINANCE relating to and regulating the production, sale; 1 and distribution of milk and milk products in the City of Everett; providing for the inspection of all equipment used in handling the same and of all premises where the same is pro- duced, prepared or sold; providing penalties for the violation thereof and repealing Ordinance No. 1642 and all ordinances and parts of ordinances in conflict herewith.
