1 • M i in their final delivery containers in the plant in which they are pasteurized. Milk and milk products sold in the distributor' s containers in quantities less than one gallon shall be delivered in standard milk bottles or in single-service containers. It shall be unlawful for hotels , soda fountains , restaurants, groceries and siailar establishments to sell or serve any milk or milk product except in the original container in which it was received from the distributor or from a bulk container equipped with an approved dis- pensing device : Provided, That this requirement shall not apply to cream consumed on the premises, which may be served from the original bottle or from a dispenser approved __or such service. It shall be unlawful for any hotel, soda fountain, restaurant , grocery or similar establishment to sell or serve any milk or milk products which have not been maintained, while in its possession, at a temperature of 50°F. or less. No milk or milk products shall be permitted to come in contact with equipment with which a lower grade of milk or milk products has been in contact unless such equipment has first been thoroughly cleaned and subjected to bactericidal treatment . Bottled milk or milk products, if stored in water, shall be so stored that the tops of bottles will not be submerged. It shall oe the duty of all persons to whom milk or milk products are delivered to clean thoroughly the containers in which such milk or milk products are d elivered before returning such con- tainers. Apparatus , containers , equipment and utensils , used in the handling , storage , processing or transporting of milk or milk prod- ucts shall not be used for any other purpose without the permission of the health officer. Section 11. IviILK PRODUCED AND PASTEURIZED AT A POINT BEYOND CITY LIT ITS. It shall be unlawful for any person, firm, as- sociation or corporation to sell or offer for sale or have in his possession for the purpose of sale any milk or cream unless such milk and/or cream shall have been pasteurized as required in this ordinance and shall have been pasteurized within the city limits of the City of Everett or within the radius of ten (10) miles of the limits of the City of Everett , said distance to be determined by the ordinary and usual roads and hiThways used by people coming into Everett. Section 12. SALE OF RAW =ILK PROHIBITED. It shall be unlawful for any person, firm, association or corporation toll any raw milk or cream and/or unpasteurized milk or cream, for human consumption within the City limits of the City of Everett. The sale of raw milk or cream otherwise complying with this ordinance to processors for pasteurization shall be lawful. Section 13. FUTURE DAIRIES AND :':ILK PLANTS. All dairies and milk plants from which milk and milk products are supplied to the City of Everett which are hereafter constructed , reconstructed or extensively altered shall conform in their construction to the requirements of this ordinance for grade A dairy farms producing milk for consumption as grade A pasteurized milk; Provided, That the requirement of a two-room milk house shall be waived in the case of dairies the milk from which is to be pasteurized. Properly pre- pared plans for all dairies and milk plants which are hereafter con- structed, reconstructed or extensively altered shall be submitted - 13 -
