• <br /> .f - I v 4 <br /> ORDINANCE NO. 3132 . <br /> AN ORDINANCE providing for the improvement of Madrona Avenue <br /> from Mukilteo Boulevard to the junction of Mukilteo Boulevard with <br /> Seahurst Avenue by grading to proper grade, construction of a Port- <br /> land cement concrete pavement with integral concrete curbs, instal- <br /> lation of necessary drainage, and by doing such other work as may <br /> be necessary in connection therewith to make a complete improvement, <br /> in accordance with a petition signed by the owners of more than <br /> seventy-five (75%) per cent of the lineal frontage and seventy-five <br /> (75%) per cent of the area within the proposed district, petitioning <br /> for said improvement, and requesting that the limits of assessment <br /> be raised to not more than two times the assessed valuation, and <br /> the cost of the improvement exceeding such assessment having been <br /> deposited in cash; creating a local improvement district; creating <br /> a local improvement district fund therefor; providing that fifty <br /> (50 ) per cent of the cost of that portion of the improvement involv- <br /> ing grading, construction of surfacing and pavement, and engineering <br /> expense, shall be paid from funds from the Washington State Develop- <br /> ment Board, and the balance of said improvement shall be borne and <br /> assessed against the property liable therefor in said district under <br /> the mode of payment by bonds, except as to payment made in cash in <br /> advance. <br /> WHEREAS, there has been heretofore filed with the City Council <br /> of the City of Everett a petition signed by the owners of more than <br /> seventy-five (750) per cent or the lineal frontage and seventy-five <br /> (75%) per cent of the area within the proposed district, petitioning <br /> for said improvement and requesting that the limits or the asses- <br /> sment be raised to not more than two times the assessed valuation, <br /> and the cost of the improvement exceeding the limits of the asses- <br /> sment having been aavanced by the petitioners and the cash deposited <br /> with the City Treasurer, and upon examination thereof the City <br /> Council has found the things set forth therein to be true, and <br /> WHEREAS, the Commissioner of Public Works has recommended <br /> to the City of Everett that said improvement petitioned for be made, <br /> and it appearing to the City Council that the public health, con- <br /> venience and necessity require that such improvement be made, <br /> NOW, THEREI,ORE, THE CiTY OF EVERETT DOES ORDAIN: <br /> Section 1: That Madrona Avenue from j'+:ukilteo Boulevard <br /> to the junction of Mukilteo Boulevard with Seahurst be graded to <br /> proper grade, construction of a Portland cement concrete pavement <br /> with integral concrete curbs, installation of necessary drainage, <br /> and doing such other work as may be necessary in connection there- <br /> with to make a complete improvement, all according to the plans and <br /> specifications prepared under the direction of the City 'ngineer, <br /> and which plans and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement, <br /> including all necessary and incidental expenses, shall be borne as <br /> follows: <br /> Fifty (50%) per cent of the cost of that portion of <br /> the improvement involving grading, construction of surfacing and <br /> pavement and engineering mpense shall be paid by funds from the <br /> - 1 <br />
