w <br /> • <br /> ORDINANCE NO. 3129. <br /> AN ORDINANCE providing for the improvement of Victor <br /> Place from Baker Avenue to Walnut Street by paving the same with <br /> Portland cement concrete pavement with integral curbs, the instal- <br /> lation of a three inch water main, end by doing such other work as <br /> may be necessary in connection therewith to make a complete im- <br /> provement, in accordance with a petition signed by the owners of <br /> more than seventy-five (75%) per cent of the lineal frontage and <br /> seventy-five (75%) per cent of the area witnin the proposed district, <br /> petitioning for said improvement and requesting that the limits of <br /> the assessment be raised to not more than two times the assessed <br /> valuation; creating a local improvement district ; creating a local <br /> improvement aistrict fund therefor; providing that fifty (50%) per <br /> cent or the cost of that portion of the improvement involving <br /> grading, construction of surfacing and pavement , and engineering <br /> expense , shall be paid by funds from the Washington State Develop- <br /> ment board, and the balance of the cost of said improvement shall <br /> be borne by and assessed against the property liable therefor in <br /> said district under the mode of payment by bonds. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a petition signed by the owners of <br /> more than seventy-five (75%) per cent of the lineal frontage and <br /> seventy-five ( 75%) per cent of the area within the proposed district , <br /> petitioning for said improvement and requesting that the limits of <br /> the assessment be raised to not more than two times the assessed <br /> valuation, and upon examination thereof the City Council has found <br /> the things set forth therein to be true, and <br /> WHEREAS, the Commissioner of Public Works has recommended <br /> to the City of Everett that said improvement petitioned for be made , <br /> and it appearing to the City Council that the public health, con- <br /> venience and necessity require that such improvement be made, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Victor Place from baker Avenue to <br /> Walnut Street be paved with Portland cement concrete pavement with <br /> integral curbs, the installation of a three inch water main, and <br /> doing such other work as may be necessary in connection therewith to <br /> make a complete improvement , all according to the plans and speci- <br /> fications prepared under the direction of the City Engineer, and <br /> which plans and specifications are hereby aaopted and approved. <br /> Section 2 : That the cost and expense of such improve- <br /> ment , including all necessary and incidental expenses, shall be <br /> borne as follows: <br /> Fifty ( 50%) per cent of the cost of that portion of <br /> the improvement involving grading , construction of surfacing and <br /> pavement ana engineering expense shall be paid by funds from the <br /> Washington State Development Board, the remaining cost of said im- <br /> provement shall be borne by and assessed against the property liable <br /> therefor in the district herein created in accordance with law. <br /> - 1 <br />
