w • ORDINANCE NO. 3129. AN ORDINANCE providing for the improvement of Victor Place from Baker Avenue to Walnut Street by paving the same with Portland cement concrete pavement with integral curbs, the instal- lation of a three inch water main, end by doing such other work as may be necessary in connection therewith to make a complete im- provement, in accordance with a petition signed by the owners of more than seventy-five (75%) per cent of the lineal frontage and seventy-five (75%) per cent of the area witnin the proposed district, petitioning for said improvement and requesting that the limits of the assessment be raised to not more than two times the assessed valuation; creating a local improvement district ; creating a local improvement aistrict fund therefor; providing that fifty (50%) per cent or the cost of that portion of the improvement involving grading, construction of surfacing and pavement , and engineering expense , shall be paid by funds from the Washington State Develop- ment board, and the balance of the cost of said improvement shall be borne by and assessed against the property liable therefor in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a petition signed by the owners of more than seventy-five (75%) per cent of the lineal frontage and seventy-five ( 75%) per cent of the area within the proposed district , petitioning for said improvement and requesting that the limits of the assessment be raised to not more than two times the assessed valuation, and upon examination thereof the City Council has found the things set forth therein to be true, and WHEREAS, the Commissioner of Public Works has recommended to the City of Everett that said improvement petitioned for be made , and it appearing to the City Council that the public health, con- venience and necessity require that such improvement be made, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Victor Place from baker Avenue to Walnut Street be paved with Portland cement concrete pavement with integral curbs, the installation of a three inch water main, and doing such other work as may be necessary in connection therewith to make a complete improvement , all according to the plans and speci- fications prepared under the direction of the City Engineer, and which plans and specifications are hereby aaopted and approved. Section 2 : That the cost and expense of such improve- ment , including all necessary and incidental expenses, shall be borne as follows: Fifty ( 50%) per cent of the cost of that portion of the improvement involving grading , construction of surfacing and pavement ana engineering expense shall be paid by funds from the Washington State Development Board, the remaining cost of said im- provement shall be borne by and assessed against the property liable therefor in the district herein created in accordance with law. - 1
