Regulation#12. In approving shoreline recreational developments,the City shall ensure that the <br /> development will maintain,enhance or restore desirable shoreline features, including unique and <br /> fragile areas,scenic views and aesthetic values.To this end,the City may adjust and/or prescribe <br /> project dimensions, location of project components on the site, intensity of use,screening, parking <br /> requirements and setbacks, as deemed appropriate to achieve this intent. <br /> Staff Finding:The off-leash dog area is a City Parks project in line with the Everett Parks and <br /> Recreation Comprehensive Plan and will increase the opportunity for public access and enjoyment <br /> to the shoreline.The project will maintain the existing riparian vegetated buffer to the north and <br /> east of the project site.The project will provide fresh water and waste receptacles to the site. <br /> Utilities <br /> Regulation#1.Wherever reasonable, all new utilities shall be placed underground and existing <br /> above ground utilities shall be placed underground during normal replacement processes. <br /> Regulation#3. Utilities should be located and designed to minimize harm and mitigate impacts to <br /> critical areas,ecological functions, and ecosystem-wide processes. <br /> Staff Findings: No shoreline vegetation will be impacted as the affected area is gravel. New water <br /> lines will be placed underground and will meet City standards. <br /> PUBLIC COMMENTS: <br /> The 30-day public notice of application was issued on April 20,2020.The following comments were <br /> received. Five (5)emails were received during the public comment period.Two (2)voiced their support <br /> and three (3)voiced concerns including safety, maintenance,fiscal responsibilities, and dog waste <br /> runoff.The pertinent concerns raised by the public regarding this proposal have been addressed in the <br /> applicable regulations noted above. <br /> CONCLUSION: <br /> 1. The proposal is consistent with the Shoreline Master Program,Comprehensive Plan and Zoning <br /> Code. <br /> 2. As the area of development within shoreline jurisdiction is less than one acre,the Planning <br /> Director has authority to issue the shoreline permit decision. <br /> 3.
