City of Everett 00 6363 - 4 <br /> (d) The surety for Contractor's payment and performance bonds has provided <br /> written assurance in a form acceptable to the Owner that the Owner's pre- <br /> delivery payment(s) has no adverse effect on coverage under the bonds; and <br /> (e) Contractor has submitted certified receipts or other acknowledgment acceptable <br /> to the Owner from the material supplier confirming receipt of pre-delivery <br /> payment from the Contractor. <br /> Depending on the circumstances, the Owner may Require additional conditions. Any <br /> approval by Owner for pre-delivery payment must be in writing and in advance of the <br /> Contractor including the pre-delivery payment in a payment request to Owner. If Owner <br /> makes pre-delivery payment of any amount on material, all the Contractor's right, title, <br /> and interest in and to those materials shall be vested in the Owner, except that <br /> Contractor shall retain the obligation to make payments to the supplier and shall retain <br /> the risk of loss or damage on the material until completion of the Project. No pre- <br /> delivery payment by Owner changes any Contractor warranty or any other obligation <br /> under the Contract Documents with respect to the prepaid material. All pre-delivery <br /> payments by Owner shall be subject to withholding pursuant to Chapter 60.28 RCW. <br />
