• <br /> • <br /> r . 1 7%4 <br /> OP <br /> ORDINANCE NO. 3104 . <br /> AN ORDINANCE providing for the improvement of Seahurst Avenue <br /> from Mukilteo Boulevard to the South line of Maple heights and <br /> Seahurst Avenue Extension from the South line of Maple heights to <br /> the City Limits by the installation of a Six inch water main, fire <br /> hydrants and necessary appurtenances, and doing all other work <br /> necessary to make a complete improvement ; in accordance with a <br /> petition presented by the owners of seventy-five (75%) percent of <br /> the lineal frontage upon the improvement and seventy-five ( 75%) <br /> percent of the owners of the area of the property within the im- <br /> provement , requesting that the limitation of the assessment be <br /> raised to twice the assessed valuation to finance the improvement , <br /> creating a local improvement district fund therefor, and providing <br /> for the payment of said improvement by special assessment on the <br /> property in said district under the mode of payment by bonds. <br /> faEREAS, there has heretofore been filed with the City <br /> Council of Everett a petition for a local improvement as herein- <br /> after set forth, signed by seventy-five (75%) percent of the owners <br /> of the area within the district , and by owners or seventy-five (75%) <br /> percent of the lineal frontage upon said improvement, requesting <br /> that such limitation of assessment be raised to twice the assessed <br /> valuation, and <br /> WHEREAS, the said petition has been referred to the <br /> Commissioner of Public "orks to be examined by said Commissioner and <br /> City Engineer , and the Commissioner of Public orks has filed with . <br /> . the City Council all data and ini'orm_ation required by law, and <br /> 1,111EREAS, said Commissioner of Public Works has recommended <br /> to the City Council that said improvement petitioned for be mace, and <br /> it appearing to the city Council that the public health, convenience <br /> and necessity requires that such improvement be made , and the City <br /> Council having unanimously voted for the construction of said <br /> Iimprovement as a public necessity, <br /> NOW, THEREFORE, TPF CITY OF 'E /EHETT DOES ORDAIN: <br /> Section 1 : That Seahurst Avenue from Mukilteo Boulevard <br /> to the Sout'1 line of Maple Heights end Seahurst Avenue Extension <br /> from the South line of Maple Heights to the City Limits be improved • <br /> by the installation of a Six inch water main, fire hydrants and <br /> necessary appurtenances, and doing all other work to make a complete <br /> improvement , all according to the plans and specifications prepared <br /> under the direction of the City Engineer, and which plans and <br /> specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement , <br /> including all necessary incidental expense , shall be uorne by and <br /> I assessed against the property included in the assessment district <br /> 1. herein created in accordance with law.
