AN ORDINANCE providing for the improvement of Seahurst Avenue from Mukilteo Boulevard to the South line of Maple heights and Seahurst Avenue Extension from the South line of Maple heights to the City Limits by the installation of a Six inch water main, fire hydrants and necessary appurtenances, and doing all other work necessary to make a complete improvement ; in accordance with a petition presented by the owners of seventy-five (75%) percent of the lineal frontage upon the improvement and seventy-five ( 75%) percent of the owners of the area of the property within the im- provement , requesting that the limitation of the assessment be raised to twice the assessed valuation to finance the improvement , creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. faEREAS, there has heretofore been filed with the City Council of Everett a petition for a local improvement as herein- after set forth, signed by seventy-five (75%) percent of the owners of the area within the district , and by owners or seventy-five (75%) percent of the lineal frontage upon said improvement, requesting that such limitation of assessment be raised to twice the assessed valuation, and WHEREAS, the said petition has been referred to the Commissioner of Public "orks to be examined by said Commissioner and City Engineer , and the Commissioner of Public orks has filed with . . the City Council all data and ini'orm_ation required by law, and 1,111EREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be mace, and it appearing to the city Council that the public health, convenience and necessity requires that such improvement be made , and the City Council having unanimously voted for the construction of said Iimprovement as a public necessity, NOW, THEREFORE, TPF CITY OF 'E /EHETT DOES ORDAIN: Section 1 : That Seahurst Avenue from Mukilteo Boulevard to the Sout'1 line of Maple Heights end Seahurst Avenue Extension from the South line of Maple Heights to the City Limits be improved • by the installation of a Six inch water main, fire hydrants and necessary appurtenances, and doing all other work to make a complete improvement , all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement , including all necessary incidental expense , shall be uorne by and I assessed against the property included in the assessment district 1. herein created in accordance with law. The City of Everett shall not 1 be liable in any manner for any portion of the costs and expenses . 1 of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett.
