CITY OF EVERETT SPECIAL PROVISIONS <br /> Harbor Workers' Compensation Act as administered by the U.S. Department of <br /> ' Labor. <br /> If the Contractor is working from barges or any other watercraft, owned or non- <br /> owned, the Contractor shall maintain Protection and Indemnity (P&I) insurance <br /> ' providing coverage for actions of the crew to third parties to the same limits stated <br /> under 1-07.18(5)A of this section for Commercial General Liability Insurance. The <br /> Contractor shall also provide proof of insurance coverage in compliance with the <br /> statutory requirements of the Merchant Marine Act of 1920 (the "Jones Act"). <br /> 1-07.18(5)E Excess or Umbrella Liability <br /> The Contractor shall provide Excess or Umbrella Liability coverage at limits of <br /> ' $1,000,000 million per occurrence and annual aggregate. This excess or umbrella <br /> liability coverage shall apply, at a minimum, to both the Commercial General and <br /> Auto insurance policy coverage. <br /> This requirement may be satisfied instead through the Contractor's primary <br /> ' Commercial General and Automobile Liability coverage, or any combination thereof. <br /> 1-07.18(5)F Pollution Liability <br /> The Contractor shall provide a Pollution Liability policy, providing coverage for <br /> claims involving bodily injury, property damage (including loss of use of tangible <br /> property that has not been physically injured), cleanup costs, remediation, disposal <br /> or other handling of pollutants, including costs and expenses incurred in the <br /> investigation, defense, or settlement of claims arising out of: <br /> Contractor's operations related to this project; <br /> Remediation, abatement, repair, maintenance or other work with lead-based paint <br /> or materials containing asbestos; and <br /> Transportation of hazardous materials away from any site related to this project. <br /> Such Pollution Liability policy shall provide the following minimum coverage: <br /> $2,000,000 each loss and annual aggregate <br /> 1-07.18(5)G Professional Liability <br /> ' The Contractor, its Subcontractor and its design consultant providing construction <br /> management, value engineering, or other design-related non-construction <br /> professional services shall provide evidence of Professional Liability insurance <br /> covering professional errors and omissions. Such policy shall provide the following <br /> minimum limits: <br /> $2,000,000 per Claim <br /> If the scope of such design-related professional services includes work related to <br /> ' pollution conditions, the Professional Liability insurance shall include Pollution <br /> Liability coverage. <br /> If insurance is on a claims made form, its retroactive date, and that of all subsequent <br /> ' renewals, shall be no later than the effective date of this Contract. <br /> 1-07.18(5)H Builder's Risk <br /> If the Project includes construction of a structure, the Contractor shall procure and <br /> ' maintain during the life of the Contract, or until acceptance of the project by the City, <br /> whichever is longer, "All Risk" Builders Risk or Installation Floater Insurance at least <br /> as broad as ISO form number CP0020 (Builders Risk Coverage Form) with ISO <br /> form number CP0030 (Causes of Loss - Special Form) including coverage for <br /> collapse, theft, off-site storage and property in transit. The coverage shall insure for <br /> direct physical loss to property of the entire construction project, for 100% of the <br /> ' Water Main Replacement"W" Division 1 -GENERAL REQUIREMENTS April,2022 <br /> WO No.-UP3766 SP-87 <br />
