• <br /> ORDINANCE No.3083 . <br /> AN ORDINANCE providing for the improvement of 13th <br /> Street from Colby Avenue to lAetmore Avenue by paving the same with <br /> Portland cement concrete pavement and integral curbs, or as an <br /> alternate, by paving with a oituminous pavement and concrete curbs <br /> and gutters; including as a part work <br /> reconstruction installation <br /> of of <br /> all needed surface drainage ; construction or <br /> concrete sidewalks where necessary; gracing or regarding as may ue <br /> necessary, and doing all other work as may be necessary in connection <br /> therewith to make a complete improvement, all in accordance with <br /> Resolution No. 5137 of the City of Everett ; creating a local im- <br /> provement district ; creating a local improvement district fund <br /> therefor; providing that fifty percent of the cost of that portion <br /> of the improvement involving grading, construction of curbs and <br /> gutters, together with the necessary drainage appurtenances, <br /> construction of street surfaces and pavements and engineering <br /> expenses shall be paid by funds from the Washington State Develop- <br /> menthoard, and the balance of the cost of said improvement shall <br /> be made by special assessment on the property in said district <br /> under the mode of payment by bonds. <br /> ?.AREAS, by hesoLution No. 5137 the City Council of <br /> the City of Everett has declared its intention to order the improve- <br /> ment as auove outlined, and doing all work in connection therewith <br /> to make a complete improvement in accordance ith the plans and <br /> specifications as prepared by the City Lngineer of the City of <br /> Everett . <br /> NOW, THEREFORE, 'T' CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That 13th Street from Colby Avenue to <br /> 7etmore Avenue be improved by paving the same with Portland cement <br /> concrete pavement and integral curbs, or as an alternate , by <br /> paving with a uituminous pavement and concrete curbs and gutters; <br /> including as a part of such work the installation of all needed <br /> surface drainage ; construction or reconstruction of concrete side- <br /> walks where necessary; grading or regarding as may be necessary <br /> and doing all other work as may be necessary in connection therewith <br /> to make a complete improver-ent, all according to the plans and <br /> specifications prepared under the direction of the City Engineer , <br /> and which plans and specifications are hereby adopted and approved. <br /> Section 2 : That the cost and expense of such <br /> improvement, including all necessary and incidental expenses, <br /> shall be borne as follows: <br /> Fifty percent of the cost of that portion of the <br /> improvement involving grading, construction of curbs and gutters, <br /> together with the necessary drainage appurtenances, construction <br /> of street surfaces and pavements and engineering expenses, shall <br /> be paid by funds from the Washington :Mate Development Board. <br /> All other costs and expenses shall ce borne by and <br /> assessed against the property included in the district herein <br /> created in accordance with law. <br /> The City of Everett shall not be liable in any <br /> manner for any portion of the costs and expenses of such improve- <br /> ment except as provided by Chapter 141 Session Laws of 1923, or <br /> acts amendatory thereto and the ordinances of the City of verett . <br />
