Section 3: That the cost and expense of such improve- <br /> ment , including all necessary incidental expenses, shall be borne by <br /> and assessed against the property included in the assessment dis- <br /> trict herein created in accordance with law. The City of Everett <br /> shall not be liable in any manner for any portion of the costs and <br /> expenses of such improvement , except as provided by Chapter 141, <br /> Session Laws of 1923, or acts amendatory thereto and the ordinances <br /> of the City of Everett, and except as to property included within <br /> the assessment district owned by the City of Everett as Park <br /> property. <br /> Section 4: That there is hereby established a local <br /> improvement district to be known as Local Improvement District <br /> No. 570 , which district shall include the following described <br /> property, to-wit: <br /> Beginning at an intersection of the north and south line <br /> through the center of block 9 of Swelwell 's Third Addition <br /> and the center line of the existing Nukilteo pavement , which <br /> point is 182 feet Nest of the center line of Federal Street <br /> and 225 feet, more or less , South of the South property line <br /> of 42nd Street and the true point of beginning ; thence angle <br /> right 90° for 314 feet, more or less,;, thence angle left 90° <br /> for 520 feet; thence angle right 97 00 ' for 4280feet , thence <br /> angle left 90° for 594 feet; thence angle left 3? 00 ' <br /> for 450 feet; hence angle right 29° 00 ' for 150 feet; thence <br /> angle right 90 for 181 feet; thence angle left 87° 35' <br /> for a distance of 238 feet , more or less , to the North boundary <br /> of 46th Street ; thence East along the North boundary of 46th <br /> Street for 795 feet, more or less, thence angle left 90° <br /> for 416.57 feet ; thence angle right 90° for 220 feet , more or <br /> less , to a point on the East boundary line of the Parkland <br /> Lutheran Children's Home ; thence angle left 90° 06' for <br /> a distance of 465 feet , more or less , along the East boundary <br /> line of the Parkland Lutheran (%hildren's Home to the Northeast <br /> corner thereof; thence angle left 90° 23' along the North <br /> line of said Parkland Lutheran Ohildren's Home for a distance <br /> of 148.44 feet to an intersection with the Pest line of <br /> Federal Street running through .horest Park; thence Northerly <br /> along the West line of Federal Street through Forest Park for <br /> 928 feet , more or less, to the intersection of said 'Jest line <br /> and the center line of the existing lukilteo Pavement; thence <br /> in a Northwesterly airection around a curve to the right along <br /> the center line of the Nukilteo pavement , as platted, for a <br /> distance of 150 feet , more or less, to the true point of <br /> beginning. <br /> Section 5: A special fund is hereby created to be <br /> called Local Improvement District Fund 570, which shall consist <br /> in the aggregate of the several amounts assessed, levied and <br /> collected on the several lots , tracts and parcels of land in said <br /> local improvement district , and the proceeds of the sale of the <br /> bonds in said district, for the purpose of defraying the cost and <br /> expense in said district of such improvement . Out of said fund <br /> shall be paid the bonds, the interest thereon and the entire cost <br /> of such improvement. <br /> -2- <br />
