Marine View Drive, Everett, WA 98201 <br />B. The city project manager will coordinate with the awarded supplier the delivery of each unit to the <br />specified address listed above. The city will be responsible for offloading each delivered unit and <br />placement into the designated location. <br />C. The supplier assumes responsibility for the delivery of all equipment quoted. <br />D. Suppliers must certify the quoted equipment can be delivered within the stated number of days on <br />their quote. <br />2.5 SPECIAL CONDITIONS OR PROVISIONS <br />It is anticipated that this project will be funded in part by the Washington State Department of Ecology. <br />Neither the State of Washington nor any of its departments or employees are, or shall be, a party to this <br />contract or any subcontract. <br />Third -Party Beneficiary: All parties agree that the State of Washington shall be and is hereby named as an <br />express third -party beneficiary of this contract, with full rights as such. <br />Protection of the Environment: No construction related activity shall contribute to the degradation of the <br />environment, allow material to enter surface or ground waters, or allow particulate emissions to the <br />atmosphere, which exceed state or federal standards. Any actions that potentially allow a discharge to <br />state waters must have prior approval of the Washington State Department of Ecology. <br />2.6 BRAND NAME OR EQUAL <br />W <br />This is NOT a brand name specification. When a special brand is named, it shall be construed solely for the <br />purpose of indicating the standards of quality, performance, or use desired. Similar item or items of <br />manufacturers other than those listed will be considered if comparable in quality and function. It will be <br />the responsibility of the bidder to provide all technical information as to the acceptability of the alternate <br />item(s). The item(s) must fit the City's needs exactly or be returned for full credit. <br />The City of Everett shall be the sole judge about whether an item submitted as an equal or alternate is <br />acceptable. The responsibility of demonstrating to the City of Everett's satisfaction that a product is <br />"equal" to that specified shall be on the supplier proposing the substitution. <br />If proposing an alternative brand, suppliers must provide marketing material, brochures or a catalog, <br />showing how your proposed unit will meet the City of Everett's needs. The material must provide <br />information on unit including filtering media and overall Modular Wetland System — Linear operation. <br />2.7 PAYMENT <br />Within thirty (30) days after delivery, acceptance of items ordered and a properly prepared invoice but <br />not more often than once per month the City of Everett will pay the Supplier according to the rate(s) <br />stated on the price sheet. <br />No down payment or advance payment of any kind will be made. Washington State law requires proof <br />that the materials have been furnished, the services rendered, or the labor performed as described before <br />payment may be made.
