Bid security shall serve as evidence of good faith and as a guarantee that if awarded the <br /> Contract the Bidder will execute the Contract and provide bonds as required by the Bid. <br /> Should the successful Bidder fail to enter into the Contract, furnish a satisfactory <br /> performance and payment bond, and furnish evidence of insurance within 14 calendar <br /> days after the award date, the certified check, cashier's check or bid bond shall be <br /> forfeited as liquidated damages. I <br /> 1.9 LIST OF SUBCONTRACTORS 1 <br /> A. Bidder shall complete SECTION 004336 - SUBCONTRACTORS FORM and submit it <br /> with the Bid. ' <br /> 1.10 REJECTION OF ANY AND ALL BIDS <br /> A. The City reserves the right to reject any and all Bids. <br /> 1.11 RETURN OF BID SECURITY , <br /> A. Within 15 calendar days after the Bids are opened, the City will return the bid security <br /> accompanying the Bids that are not to be considered in making the award. All other bid <br /> securities will be held until the Contract has been fully executed; after which they will be <br /> returned to the respective Bidders whose Bids they accompanied. <br /> 1.12 AWARD OF CONTRACT <br /> A. Evaluation of Bids 1 <br /> 1. Bids will be evaluated by the City to determine which bid is the lowest responsive <br /> bid by a responsible bidder and which bid, if any, should be accepted in the best <br /> interest of the City. The City, in its sole discretion, reserves the right to accept or <br /> reject any and all bids submitted and to waive informalities and minor irregularities. <br /> a. LOWEST: The City will award the Project to the responsive and responsible <br /> bidder whose Bid is the lowest. In accordance with RCW 39.04.380, if a bid <br /> is received from a nonresident contractor from a state that provides an in- <br /> state percentage bidding preference and does not have an office located in <br /> Washington, then a comparable percentage disadvantage will be applied to <br /> the bid of that nonresident contractor. <br /> b. RESPONSIVENESS: City will consider all the material submitted by the <br /> bidder to determine whether it is in compliance with the Contract Documents. <br /> The City reserves the right, at its discretion, to reject nonresponsive Bids. <br /> c. MANDATORY RESPONSIBILITY: <br /> 1) Mandatory Responsibility Criteria: RCW 39.04.350(1). It is the intent <br /> of City to award a contract to the lowest responsive and responsible <br /> Bidder. Before award, the Bidder must meet the Bidder responsibility <br /> criteria under this Section to be considered a responsible Bidder. The <br /> Bidder may be required by the City to submit documentation <br /> demonstrating compliance with the criteria under this Section.
