Bid security shall serve as evidence of good faith and as a guarantee that if awarded the Contract the Bidder will execute the Contract and provide bonds as required by the Bid. The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted and to waive informalities and minor irregularities. a. LOWEST: The City will award the Project to the responsive and responsible bidder whose Bid is the lowest. In accordance with RCW 39.04.380, if a bid is received from a nonresident contractor from a state that provides an in- state percentage bidding preference and does not have an office located in Washington, then a comparable percentage disadvantage will be applied to the bid of that nonresident contractor. b. RESPONSIVENESS: City will consider all the material submitted by the bidder to determine whether it is in compliance with the Contract Documents.
