BOX 1107 <br /> EVERETT, WASHINGTON 98206 <br /> WATER MAIN INTERIM CONNECTION AGREEMENT <br /> WHEREAS, we the undersigned (the "Petitioner") are the owners of the following <br /> described property, to-wit: <br /> (ALSO KNOWN AS ) recorded under Recording No. <br /> WHEREAS, the above described property does not abut a water main of Public Utility <br /> District No.,1 of Snohomish County, Washington (the "District"), and the Petitioners do hereby <br /> apply to the District for the privilege of making an interim connection to a water main of the <br /> District, located at <br /> WHEREAS, the District is willing to allow such an interim connection only upon the <br /> specific condition, covenant, agreement, and understanding that the Petitioner agrees to and <br /> shall comply with the terms and conditions set forth below. <br /> NOW, THEREFORE, it is agreed between the Petitioner and the District as follows: <br /> 1 . The District will install standard water service from main to the edge of public right- <br /> of-way or easement and the Petitioner is responsible for installing and maintaining any <br /> additional water service line from District's meter to his place of service. <br /> 2. Petitioner shall obtain and maintain all easements, property rights, and/or permits <br /> necessary for the interim connection. <br /> 3. Petitioner shall pay all applicable connection charges and the monthly water rate for <br /> the interim connection as established and amended from time-to-time by the District. <br /> 4. If and when a District water main is constructed which is adjacent to said property <br /> Petitioner, within sixty (60) days of receiving written notice from the District, shall pay all <br /> applicable latecomer's fees or LUD. <br /> 5. Petitioner shall, if requested, sign a petition for the formation of a Local Utility <br /> District (LUD) for new water main or mains which benefit Petitioner's property, and agrees <br /> not to protest or object to such formation. <br /> 6. Petitioner shall defend, idemnify, and hold harmless the District, its officers, <br /> agents, servants, and employees, of and from any loss or damages, or claims or actions for loss <br /> or damages, caused by or arising out of or in any way related to the quality, quantity, or amount <br /> of pressure provided by the District pursuant to this Agreement. <br />
