SEPA MDNS <br /> South Terminal Modernization,Phase 2 <br /> age4of5D <br /> turbidity, and avoid adverse noise effects on fish and marine mammals from pile driving and overwater <br /> construction activities. <br /> 3. The Port will implement the following Best Management Practices (BMPs): <br /> a. A Spill Prevention, Control and Countermeasure (SPCC) plan will be implemented to avoid and <br /> minimize potential releases of fuel and petroleum products used by construction equipment both on the <br /> upland side and barge mounted crane side of equipment to the marine environment. <br /> b. All construction activities will be controlled by BMPs intended to avoid and minimize potential releases <br /> of fugitive materials to the aquatic environment. These BMPs may include such measures as use of a <br /> floating surface boom. <br /> c. To minimize potential noise related impacts, all piles will be driven with a vibratory pile driver. An <br /> impact pile driver will only be used to reach required tip elevations in the event that vibratory action is not <br /> sufficient to overcome soil resistance, or to proof piles for load bearing capacity. A bubble curtain will be <br /> deployed for all impact pile driving to reduce waterborne noise. All non-load bearing fender piles at the <br /> face of the wharf will be driven with a vibratory hammer only. <br /> d. To minimize the resuspension of surface sediments during pile driving,clean sand will be placed in the <br /> new pile footprint at a depth of no more than six inches to create a temporary sand "cap". <br /> e. If required by the Federal Services in order to minimize injury and behavioral disturbances to marine <br /> mammals,trained biologists knowledgeable in the identification of orcas and other marine mammals will <br /> be positioned on the South Terminal wharf to observe the area during all periods of pile driving. All <br /> observers will have a direct communication link with the pile driving supervisor and will stop pile driving <br /> if any marine mammal comes within the disturbance threshold defined by the proposal's Draft Biological <br /> Evaluation. <br /> f. Appropriate use as required of a Marine Mammals Protection Plan during construction of the project.This <br /> plan was prepared as part of the proposal's Draft Biological Evaluation. <br /> g. The Port will correspond with the United States Fish and Wildlife Service(USFWS) to determine if <br /> marbled murrelet monitoring using established murrelet monitoring protocols will be required. <br /> h. All in-water work will also occur during agency-approved work windows when few outmigrating juvenile <br /> salmon are present in the nearshore of Port Gardner. <br /> i. A water quality monitoring plan would be developed and implemented, if required, during construction to <br /> verify compliance with water quality conditions of the Section 401 Water Quality Certificate, and other <br /> state and federal permits for the proposal. <br /> j. Applicable Port BMPs for reducing and controlling surface, ground, and runoff water and drainage <br /> pattern impacts. <br /> k. All construction equipment would be inspected daily to ensure that it is in proper working condition. <br /> 1. All site lighting used to facilitate nighttime cargo handling operations will continue to be aimed and <br /> shielded to minimize potential light and glare impacts on adjoining in-water areas. <br /> m. Care will be taken to prevent any petroleum products,chemicals, or other toxic or deleterious materials <br /> from entering the water. If a spill were to occur work shall be stopped immediately, steps taken to <br /> contain the material, and appropriate agency notification shall occur.Fuel hoses, oil drums or fuel <br /> transfer valves and fittings, etc., shall be checked regularly for drips or leaks, and shall be maintained and <br /> stored to prevent spills. <br /> n. Excess or waste material shall not be disposed of or abandoned water ward of the OHWM or MHHW <br /> lines, or allowed to enter waters of the state. <br /> o. The Contractor shall have a spill containment kit,including oil absorbent materials, on the site to be used <br /> in the event of a spill or if any oil product is observed in the water. <br /> p. A debris boom will be installed around the active construction area during construction work. <br /> 4. The Port of Everett's Environmental BMPs shall apply to the proposal's construction and subsequent terminal <br /> operations. <br />
