FINDINGS AND DECISION OF THE HEARING EXAMINER OF THE CITY OF EVERETT IN THE MATTER OF THE APPLICATION OF THE PORT OF EVERETT FOR APPROVAL OF A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT SMA#16-009 "SOUTH TERMINAL" SUMMARY A shoreline permit for improvements to the south OF DECISION: terminal wharf located on the shoreline of Puget Sound in Everett, Washington, is approved. The shoreline permit allows for the demolition of an ' existing warehouse building, installation of steel piles to upgrade the wharf load bearing capacity, replacement of timber fender piles with new steel piles, installation of two new 100-foot gauge rail beams on the wharf to support two gantry cranes and the upgrade of utilities to support the electric powered cranes and provide shore-based power capacity for ships. Related activities for this project are also approved. The shoreline permit is subject to the conditions as set forth herein. INTRODUCTION The Port of Everett (referred to as either Port or Applicant) requested approval of a Shoreline Substantial Development Permit (shoreline permit) for improvements to the existing south terminal wharf on the shoreline of Puget Sound in the City of Everett, Washington. The project is subject to the jurisdiction of the Shoreline Act of the State of Washington (RCW 90.58) because the shoreline activity will be done near a significant shoreline of the State of Washington and will exceed the threshold monetary amount that necessitates shoreline jurisdictional review. A hearing on the request was held before the Hearing Examiner of the City of Everett on April 6, 2017.
