Preceding action: N/A Fund: N/A Fiscal summary statement: None Project summary statement: Riverview I, LLC is the developer of a multi -family apartment project located at 1622 E Marine View Drive. On September 9, 2020, Riverview recorded an easement, recorded under Recording Number 202009090197 (the "Old Easement"), burdening the Property at and benefitting the City. The purpose of the Easement was to allow the City to convey water across the Property. On April 11, 2022, Riverview recorded another easement, recorded under Recording Number 202204110516 (the "New Easement"), burdening the Property and benefitting the City. The New Easement provides the same rights granted under the Old Easement, but within an amended easement area. Because the City and Riverview have entered into the New Easement, the Old Easement is no longer necessary, and the City now wishes to release any and all rights it retains under the Old Easement. Recommendation (exact action requested of Council): Authorize the Mayor to sign the Release of Easement.
