If the Contractor determines that because of weather or similar reasons the Contractor cannot achieve physical completion of the Project in 2022, then the Contractor may suspend the Project until Spring 2023. This suspension is at no cost to the City. If Contractor decides to do this, then: a. The Contractor will give the City prior written notice of the date the suspension will start. b. Contract Time will suspend (that is, stop running) between suspension start date and the 2023 restart date. c. The Contractor will restart work in Spring 2023. The Contractor will give the City prior written notice of the work restart date. The restart date is subject to City approval. The City agrees that it will approve a restart date so long as (i) the restart date does not increase Contract Time by more than 60 calendar days and (ii) restart date will cause the Project to be physically complete no later than May 31, 2023. If an adjustment of Contract Time is needed to accommodate the restart date, then the parties will execute an agreed change order with the Contract Time adjustment. d. Contractor is responsible to protect uncompleted work during the suspension.
