WA ST Dept of Ecology 9/29/2022 Amendment 1

AMENDMENT NO. 1 TO AGREEMENT NO. WQC-2019-EverPW-00051 BETWEEN THE STATE OF WASHINGTON DEPARTMENT OF ECOLOGY AND City of Everett PURPOSE: To amend the above-referenced agreement (AGREEMENT) between the state of Washington Department of Ecology (ECOLOGY) and City of Everett (RECIPIENT) for the Reduction of CSOs at Two Snohomish River Outfalls (PROJECT). The RECIPIENT experienced site feasibility setbacks which stopped the original PROJECT from proceeding . The PROJECT was rescoped to a complex design that fits ECOLOGY criteria in the same basin as the original PROJECT . This amendment will extend the AGREEMENT from June 30, 2022 to June 30, 2023 to provide the recipient with additional time to analyze the two proposed alternatives, complete design, and to close out deliverables. This amendment will also modify the PROJECT title, description, scope, and redistribute funds from Tasks 3 and 4 to Task 2, as the RECIPIENT will now prepare only a design for the PROJECT under this AGREEMENT and will no longer complete construction . The budget will be adjusted as follows: Task 2 is increased by $1,359,500.00, from $253,050.00 to $1,612,550.00 (SFAP + SFAP GRI) Task 3 is reduced by $30,000.00, from $30,000.00 to $0.00 Task 4 is reduced by $1,329,500.00, from $1,329,500.00 to $0.00 The expiration date is extended from 6/30/2022 to 6/30/2023. The agreement SOW is modified from Design /Construct to Design Only.
