I am hoping that in this email chain, we <br /> can all get on the same page and put together a clear plan to resolve the issues with the Property. <br /> After reviewing the correspondence between Laura and Tony, it was my understanding that the issue was structural (i.e. <br /> the residential structure met the definition of a duplex, but is only permitted as a single family residence, and is in a <br /> zone that does not allow duplexes).After speaking with Steve, I now understand there is an issue of"use" (i.e. the attic <br /> could be used as an office space, as a storage space, etc., without the need for an additional permit; the issue is it's use <br /> as an additional unit) that could play a role in resolving this issue. Could either of you give some more insight into <br /> whether this is a structural violation, a use violation, or a combination of the two? <br /> Additionally, Laura has confirmed to me that the wiring for the stove has been removed so that the kitchenette no <br /> longer qualifies as a "kitchen." Laura also informed me that the attic has internal access via an attic ladder which is <br /> located in a bedroom closet.The ladder is unusable at this point because flooring was installed over the opening in the <br /> attic; if this flooring is removed,would this satisfy the "internal access" requirement? <br /> So essentially, the state of the attic right now is: external access via stairwell, internal access via attic ladder if the <br /> flooring is removed, a bathroom, a kitchenette that no longer has a stove or wiring for a stove, a bathroom, a bedroom, <br /> and a living space.The solutions that have been presented thus far are 1)to get a permit for the attic to be considered <br /> an accessory dwelling unit(ADU), or 2)obtain a permit for and construct an internal stairwell to connect the attic to the <br /> remainder of the house.There seems to be another solution of changing the use of the attic so that it is no longer used <br /> as a separate unit. Here are my questions for each solutions.. <br /> 1. ADU <br /> - What needs to happen for the attic to be successfully permitted as an ADU?Would the stove need to be re- <br /> wired?Would we need separate permits for the kitchen and existing bathroom, before obtaining a permit <br /> for an ADU?What would this process look like, and who should we contact to get this started? Is the <br /> external stairwell an issue (i.e., would this need to be permitted separately as well)? <br /> 2. Internal Stairwell <br /> - Does the attic ladder, if made usable, qualify as an internal connection?Would we need a permit to remove <br /> the flooring over the opening in the attic?Would we still need to get the bathroom permitted (or any other <br /> structural elements of the attic permitted-such as the external stairwell, etc.)?No,the attic ladder is not <br /> adequate as an internal connection if you are keeping the bedroom and/or kitchenette.The bathroom can <br /> stay without an internal connection if a building permit is obtained. <br /> 3. Use <br /> - If the Workman's are open to changing the use of the attic as a separate unit, what needs to be done <br /> structurally for it to no longer be considered a separate dwelling unit?Steve indicated that we would not <br /> need an internal connection if this was used as a storage space, it just cannot be used as a living space.The <br /> wiring for the stove has already been removed, the remainder of the kitchenette could likely be easily <br /> removed. Would this be sufficient?Would we need to address the bathroom (i.e.,get it permitted or <br /> removed; if removed-what is required for the bathroom to be considered "removed." Would capping the <br /> plumbing be sufficient?Would they need to remove the bathtub, etc.)? <br /> 2 <br />
