We had previously spoken about the fact that in both of these scenarios, the main unit would need to be "owner
occupied." I may have confused things on this matter, so I wanted to clear that up. I was previously under the
impression that the Workman's wanted to keep the property as a rental property. I now understand that they are
interested in getting these issues resolved as quickly as possible so that they can sell the property. It is my understanding
that the owner occupied requirement was only relevant if the Workman's(or any subsequent owner)wanted to rent out
the ADU as a separate unit, correct? In other words, if the attic is permitted as an ADU, in order for the ADU to be
rented out to a third-party(separate "family"),the main unit would need to be owner occupied. But there is no need for
the residence to actually be owner occupied (i.e.,the Estate does not need to "occupy"the property)to get the attic
permitted as an ADU to address the violation, correct?Additionally, once the attic is permitted as an ADU,there is no
need for the main unit to be owner occupied unless the ADU is being rented out, correct? One of the units has to be
owner occupied,it does not have to be the main unit;
If you all could come back to us with some options on how we can fix this, that would be great. Please let us know if
there are any other solutions to this that haven't yet been considered, such as re-opening the attic ladder access. It is
my understanding that the Workman's are open to considering all options to get this resolved as quickly as possible. It
may be helpful if someone from the appropriate department could meet the Workman's at the property to advise them
of their options and get a full understanding of the attic and what needs to be done to address it. Could any of you help
us with this or get this set up?The Workman's are eager to get this resolved to the City's satisfaction, but don't know
where to start or what is required of them.Your collective guidance is greatly appreciated!
Sincerely,
Mallory Zimmerman,J.D.
Claims Administrator,AVP
Fidelity National Title Group
Omaha Claims Center
2533 North 117th Avenue
Omaha, NE 68164
402-498-7186
mallory.zimmermant fnf.com
FIDELITY
NATIONAL
NOTICE: The information contained in this message is proprietary and/or confidential and may be privileged.
