Previously, when a violation citation was issued, it had to <br />go before the violations hearing examiner to determine whether the notice should be upheld. This meant <br />properties were out of compliance for longer periods of time, and violators had little incentive to bring their <br />properties into compliance because they could plead their case before the hearing examiner. <br /> <br />Under the new code, the code enforcement official can serve a notice and order directly on the violator, who <br />can either choose to comply with the order, or appeal the order to the hearing examiner. This process ensures <br />that the City can move expediently to require code compliance but allows violators to retain their due process <br />and ability to challenge the issuance of a code compliance order. <br /> <br />Following is a list of the other significant changes that are proposed: <br /> <br />A. Applicability (EMC 1.20.020) <br /> <br />Staff are recommending that the scope of other code chapters that EMC 1.20 is applicable to be expanded to <br />ensure city code enforcement officials are empowered to seek compliance with all applicable code provisions. <br />The new additional applicable chapters include: <br /> <br />1.
