<br />to prevent an imminent danger to public or private property, or to prevent an imminent threat of serious <br />environmental degradation. <br />“Enforcement Actions” means the actions ascribed in EMC 1.20.080(B). <br />“Owner” shall mean any person, agent, operator, firm or corporation having a legal or equitable interest <br />in the property; or recorded in the official records of the state, county or municipality as holding title to <br />the property; or otherwise having control of the property, including the guardian of the estate of any such <br />person, and the personal representative or executor or administrator of the estate of such person if <br />ordered to take possession of real property by a court, as well as a bankruptcy trustee. <br />“Person” shall mean an individual, a firm, partnership, association, institution or corporation or any other <br />group acting as a unit, or agent thereof. <br />“Person responsible” or “responsible person” means the owner, occupier, tenant, manager, agent or <br />other person who caused or is causing the code violation under this chapter or other regulation. <br />“Repeat violation” shall mean a violation of the same regulation in any location by the same person, for <br />which a notice and order has been issued and was not timely appealed or was denied on appeal, within <br />twenty-four months of the issuance of such order. A repeat violation may involve the same condition, <br />action, or omission as a previous violation. A repeat violation may also involve non-compliance with the <br />corrective action noted in the notice and order which results in the issuance of an additional order. <br />“Stop Work Order” shall mean an order issued pursuant to EMC 1.20 by the Code Enforcement Officer <br />under its police power authority in response to an actual or potential threat or risk to the health, safety, <br />or welfare of people, property, city infrastructure or the environment. <br />“Violation” shall mean any condition, act, failure to act or omission that is inconsistent with any code <br />provisions referenced in EMC 1.20.020. <br />1.20.040 Declaration of Public Nuisance. <br />In addition to the penalties provided by this chapter, any condition caused or allowed to exist in violation <br />of any of the provisions of the code is a public nuisance and all remedies given by law for the prevention <br />and abatement of nuisances shall apply to any such nuisance or person responsible therefor, regardless <br />of the institution or imposition of criminal or civil remedies stated herein. <br />1.20.050 Right of Entry. <br />A Nonemergency Permissive Entry. Upon presentation of proper credentials, the Code Enforcement <br />Officer may, with the consent of the property owner or other responsible person, or pursuant to <br />a lawfully issued warrant, enter such property at all reasonable times to perform the duties of this <br />chapter. <br />B. Refusal of Entry. If entry is refused or cannot be obtained, the Code Enforcement Officer may <br />apply to a court of competent jurisdiction to obtain entry, and/or shall have recourse to every <br />remedy provided by law to secure entry.
