Shoreline Regulations <br /> Below are the most relevant regulations excerpted from the Shoreline Master Program <br /> (SMP) along with staff findings where appropriate. The project is subject to all applicable <br /> SMP regulations, whether cited below or not. <br /> Section 3—General <br /> 1. All exterior lighting, including lighting of signs, shall be directed downward onto the site <br /> and away from other shoreline properties or nearby neighborhoods. <br /> 2. All shoreline development shall comply with the City's noise ordinance (EMC 20.08), <br /> both during and after construction. The City may require the applicant to prepare noise <br /> studies to determine if a proposal is in conformance with the ordinance. <br /> 3. Warning devices on vehicles (back up beepers) are exempt from the City's noise <br /> ordinance, but are perceived as irritating by most people. When feasible, developments <br /> that abut residential zones must be designed to shield vehicle maneuvering and loading <br /> areas from residential areas by placement of buildings, berms, etc. <br /> Staff Comment: See recommended condition no. 39. <br /> 4. All shoreline developments shall be located, constructed and operated so as not to be a <br /> hazard to public health and safety. <br /> 5. Shoreline sites shall have a landscaping plan which is in scale and harmony with <br /> proposed structures and serves to provide some screening and buffering of the activities <br /> where this is appropriate. <br /> Staff Comment: The site will be landscaped in accordance with the conceptual <br /> landscaping shown on the site plan and a detailed landscaping plan to be provided with <br /> the building permit application (Recommended condition no. 31) The zoning code <br /> requires Type A landscaping, details of which are specified in Chapter 19.35 EMC. <br /> The proposed lot configuration will result in some of the landscaped areas under <br /> ownership of individual townhomes. In order to ensure that landscaping is well <br /> maintained in a uniform manner, recommended condition no. 31 requires that all exterior <br /> landscaping be maintained by the condominium association. <br /> 3.5 Cultural Resources <br /> 1. All shoreline permits shall contain provisions which require developers to immediately <br /> stop work and notify the City and the Tulalip Tribes if anything of possible archaeological <br /> interest is uncovered during excavations or development and consult a professional <br /> archaeologist to inspect and evaluate the site. Failure to comply with this requirement <br /> shall be considered a violation of the Shoreline Permit. <br /> Staff Comment: See recommended condition no. 35. <br /> 3 <br />
