Section 17: It shall be the duty of every person, <br /> firm or corporation selling oil burners of any type or make for <br /> use within the City of Everett to furnish the Fire Chief of <br /> the City of Everett the name and address of each purchaser of <br /> said oil burner within Forty-eight (48) hours after sale or <br /> delivery of said oil burner or oil burning; equipment . <br /> Section 18: No gravity oil tank shall have an oil <br /> capacity in excess of Two Hundred Fifty (250 ) gallons when in- <br /> stalled as an integral part of a gravity supply tank system. <br /> Section 19: Iny person feeling aggrieved by the <br /> refusal of the Fire Chief to issue a Certificate of Approval, <br /> Installation Permit or Certificate of Inspection when applied <br /> for, as hereinbefore provided, may within Seven (7 ) days <br /> from the time of such refusal , appeal from such decision of the <br /> Fire Chief to the City Council of the City of Everett. The said <br /> City Council shall thereupon investigate, and by notice confirm <br /> or reverse the action of the Fire Chief in said matter, which <br /> said action of the City Council shall be final and binding upon <br /> all parties concerned. <br /> Section 20 : 1,ny person violating any provision of <br /> this ordinance, either in selling, repairing, installing, main- <br /> taining, using, or operating an oil burner and/or oil burning <br /> equipment , shall be deemed guilty of a misdemeanor and upon con- <br /> viction thereof shall be fined not less than Ten Dollars ( >10.00) , <br /> nor more than i'hree hundred Dollars (4,300 .00) , for each and every <br /> violation thereof, and upon failure to pay same shall be <br /> imprisoned in the City Jail one day for every Three Dollars <br /> ( 3.00) of such fine . <br /> Section 21: Should any section, paragraph, sentence, <br /> clause or phrase of this Ordinance be declared unconstitutional <br /> or invalid for any reason the remainder of said Ordinance shall <br /> not be affected thereb7. <br /> 'section 22: It shall be th= duty of any repairman <br /> or installation man called upon to repair or install any used <br /> oil burning equipment , to examine the entire installation, <br /> including the storage or supply tanks, piping, valves, smokepipe , <br /> wiring and all other parts of said installation, and make all <br /> necessary repairs to bring said installation up to the specifica- <br /> tions as set forth in this Ordinance . <br /> In the event that the owner or agent of the property <br /> or the persons using such equipment refuses to make such repairs, <br /> it shall be the duty of said repair or installation man to <br /> notify the Fire Chief, in writing, within Twenty-four (24) hours, <br /> the name and address of the owner, agent or person using this <br /> equipment . Said notice to the Fire Uhief of the City of Everett <br /> shall contain a list of the defects noted. <br /> -13- <br />
