MV5J has submitted
permit applications to build a new multi-family apartment development on this property.
However, there are currently Snohomish County PUD power lines located in the alley east of
MV5J’s property, which hinders such development.
MV5J has coordinated with the Snohomish County PUD, the Port of Everett, and the City to plan
a proposed route to relocate the power lines away from the alley. The relocation of the power
lines will be at MV5J’s expense. The proposed new location for the power lines is across the
street from W Marine View Drive and down onto the narrow strip of parcels lying between the
BNSF railroad tracks and Lower Norton Avenue.
The City owns two of the parcels along this proposed route – one at the north end and one at the
south end. The property in-between the two City parcels is owned by the Port and by MV5J. This
proposed route requires an easement to be granted to the PUD through the affected parcels to
accommodate the power lines. All parties are amenable to this arrangement.
MV5J has requested that the City grant to the Snohomish County PUD utility easements through
the City’s parcels (tax identification numbers 00437448500000 and 00437455700900). In
exchange for these easements, MV5J will cause its parcel (tax identification number
00437455701200) to be conveyed to the City at no cost to the City. An easement to the
Snohomish County PUD will also be granted in the MV5J parcel.
The purpose of this Resolution is to authorize the Mayor to execute documents and take actions
as necessary to grant the easements and take conveyance of the above-described parcel.

Recommendation (exact action requested of Council):
Adopt a Resolution authorizing granting of utility easements to the Snohomish County PUD in
City-owned parcels in the 2400 and 2300 Blocks of Lower Norton Avenue and authorizing
conveyance to the City of one parcel in the 2400 block of Lower Norton Avenue.
