<br /> <br /> <br /> <br /> <br /> <br /> <br />RESOLUTION NO. ______________ <br /> <br />A RESOLUTION Authorizing Granting of Utility Easements to the Snohomish County PUD in <br />City-Owned Parcels in the 2400 and 2300 Blocks of Lower Norton Avenue and Authorizing <br />Conveyance to the City of One Parcel in the 2400 Block of Lower Norton Avenue. <br /> <br />WHEREAS, <br /> <br />A. The City owns parcels with tax identification numbers 00437448500000 and 00437455700900, <br />which are as shown in the attached Exhibit A. These parcels are sandwiched between the BNSF <br />railroad tracks and Lower Norton Avenue. <br /> <br />B. The owner of the parcels on the other side of Lower Norton Avenue is Marina View 5J LLC, <br />which is referred to in this Resolution as the Developer. The Developer intends to construct <br />apartments and other improvements on its parcels. However, the Snohomish County PUD’s <br />power lines are currently located in the alley east of the Developer’s parcels, which hinders <br />development. The Developer’s parcels and the current power line location are shown in the <br />attached Exhibit A. <br /> <br />C. The Developer is in the process of coordinating with the Snohomish County PUD the relocation <br />of the power lines away from the alley. The proposed new location of the power lines is shown <br />on the attached Exhibit A. <br /> <br />D. The Developer has requested that the City grant to the Snohomish County PUD utility <br />easements because the proposed new location of the power lines will run through the City’s <br />parcels described in Recital A above. In exchange for the easements, the Developer will cause <br />the parcel with tax identification number 00437455701200 to be conveyed to the City at no cost <br />to the City. This parcel is shown on attached Exhibit A, and it is also between the BNSF railroad <br />tracks and Lower Norton Avenue. An easement to the Snohomish County PUD for the power <br />lines will also be granted on this parcel. <br /> <br />E. The City’s Real Property Manager has determined that the value of the parcel to be conveyed to <br />the City is at least as much as the value of the to-be-granted easements described above. <br /> <br />F. The purpose of this Resolution is to authorize the Mayor to execute documents and take actions <br />as necessary to grant the easements and take conveyance of the above-described parcel.
