<br /> 49 <br />ARTICLE 35 – FIRE DIVISION CHIEFS <br /> <br /> <br />1. The parties have agreed to include in the bargaining unit the position of Division Chief. <br /> <br />2. Inclusion of the Division Chiefs, effective on the execution date of this Agreement, is <br />reflected in some of the above articles. Other articles apply generally to the bargaining unit. <br /> <br />3. Certain provisions of the Agreement require modification or addition, as set forth below. <br /> <br />A. Holidays: <br /> <br />Division Chiefs are entitled to the same holidays off, as set forth in Article 10 for <br />non-suppression personnel. <br /> <br />B. Overtime: <br /> <br />Notwithstanding any inconsistent aspect of Article 13, the following applies to <br />Division Chiefs: <br /> <br />1. Overtime will be paid for as defined in Article 14 <br /> <br />2. An employee, subject to the approval of the Chief or designee, may receive <br />compensatory time in lieu of overtime pay at the rate of one and one-half (1.5) <br />hours for each hour worked. The maximum accumulation of compensatory time <br />is one hundred (100) hours. Compensatory time is to be used with prior <br />approval. <br /> <br />3. Except as provided above, overtime work will only be authorized by the Chief or <br />designee. <br /> <br />C. Incentive/Specialty Pay: <br /> <br /> This section of Article 9 shall not apply to Division Chiefs. <br /> <br />4. Division Chiefs shall be selected from a single civil service list, based on civil service rules <br />and qualifications. <br /> <br />Existing Division Chiefs shall have the opportunity to apply for lateral openings when they <br />occur, with no requirement to appear on the eligible register. Civil service eligible registers <br />shall supplement the applicant pool in the event of lateral requests. <br /> <br />Division Chief roles and responsibilities shall be evaluated and redistributed at least every <br />three years, or up to annually with mutual agreement from the Union. <br /> <br /> <br />
