Section 2: "Person Subject to Court Order" <br /> As used in this chapter, "person subject to court order"means any person <br /> who is subject to an order issued under Section 1 of this ordinance. <br /> Section 3: Violation of Order <br /> Whenever a person is subject to a court order and the person knows of the <br /> order, a police officer who has probable cause to believe that the person is, <br /> in the officer's presence, violating or failing to comply with any of the <br /> conditions of the order shall have the authority to bring the person before <br /> the court wherein the order was issued, and for such purpose may rearrest <br /> such person without warrant or other process. <br /> Section 4: Third Party Liability <br /> A. It is the specific intent of this chapter that no provision nor any <br /> term used in this chapter is intended to impose any duty whatsoever upon <br /> the city or any of its officers or employees, for whom the implementation <br /> or enforcement of this chapter shall be discretionary and not mandatory. <br /> B. Nothing contained in this chapter is intended to be nor shall be <br /> construed to create or form the basis for any liability on the part of the <br /> city, or its officers, employees or agents by reason or in consequence of <br /> any act authorized or issued or done in connection with the <br /> implementation or enforcement pursuant to this chapter, or by reason of <br /> any action or inaction on the part of the city related in any manner to the <br /> enforcement of this chapter by its officers, employees or agents. <br /> Section 5: Savings <br /> The enactments of this ordinance shall not affect any case,proceeding, <br /> appeal or other matter currently pending or in any way modify any right or <br /> liability, civil or criminal,which may be in existence on the effective date <br /> of this ordinance. <br /> Section 6: Severability <br /> If any section, sentence, clause or phrase of this ordinance should be held <br /> to be invalid or unconstitutional by a court of competent jurisdiction, such <br /> invalidity or unconstitutionality shall not affect the validity or <br /> 2 <br />
