Section 2: "Person Subject to Court Order" As used in this chapter, "person subject to court order"means any person who is subject to an order issued under Section 1 of this ordinance. Section 3: Violation of Order Whenever a person is subject to a court order and the person knows of the order, a police officer who has probable cause to believe that the person is, in the officer's presence, violating or failing to comply with any of the conditions of the order shall have the authority to bring the person before the court wherein the order was issued, and for such purpose may rearrest such person without warrant or other process. Section 4: Third Party Liability A. It is the specific intent of this chapter that no provision nor any term used in this chapter is intended to impose any duty whatsoever upon the city or any of its officers or employees, for whom the implementation or enforcement of this chapter shall be discretionary and not mandatory. B. Nothing contained in this chapter is intended to be nor shall be construed to create or form the basis for any liability on the part of the city, or its officers, employees or agents by reason or in consequence of any act authorized or issued or done in connection with the implementation or enforcement pursuant to this chapter, or by reason of any action or inaction on the part of the city related in any manner to the enforcement of this chapter by its officers, employees or agents. Section 5: Savings The enactments of this ordinance shall not affect any case,proceeding, appeal or other matter currently pending or in any way modify any right or liability, civil or criminal,which may be in existence on the effective date of this ordinance. Section 6: Severability If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or 2
