<br /> 23 <br /> <br />Cayenta V9 Statement of Work <br /> <br /> <br />If HARRIS terminates this Statement of Work without cause, then it shall: <br />1. Provide notice of 10 calendar days for termination without cause. <br />2. Refund to the CLIENT any fees that have not been earned under this Statement of Work <br />through the termination date. <br /> <br />Under no circumstances shall HARRIS be liable for any special, indirect, consequential, punitive, or <br />incidental damages of any kind, including but not limited to loss of revenue, loss of profits, loss of <br />business opportunity, loss of data arising out of or in connection with this scope statement, even if <br />HARRIS has been advised of the possibility of such damages. In any event. HARRIS shall not be liable to <br />pay any amount, in the aggregate, that is greater than the fees received by HARRIS under this Statement <br />of Work. <br />
