If, during the course, or as a result of such inspection, <br /> examination and testing, a Bidder finds facts or conditions that appear to conflict <br /> or are omitted from the Contract Documents, or with other data or material made <br /> available relating to the Work, Bidder shall so notify the City in writing, and may <br /> apply to the City for additional information and explanation before submitting their <br /> Bid. <br /> B. The submission of a Bid by the Bidder shall constitute acknowledgment that, in <br /> preparing and submitting a Bid, Bidder has not only reviewed the Contract <br /> Documents, but is also relying on their own knowledge, examination, inspection, <br /> and testing of: <br /> 1. The Site of the Work, <br /> 2. Access to the Site, <br /> 3. Environmental factors, <br /> 4. All other data, matters and things requisite to the fulfillment of the Work, <br /> 5. conditions ordinarily to be encountered and generally recognized as <br /> inherent in the Work, <br /> 6. Available services and utilities at and in the vicinity of the Site of the Work, <br /> and <br /> 7. All applicable federal, state and local statutes, ordinances, and regulations <br /> dealing with building, public health and safety, or with the prevention of <br /> environmental pollution and the preservation of public natural resources, <br /> and environmental assessments or impact statements which have been <br /> prepared relating to the Work. ' <br /> C. Bidder acknowledges that he/she has not relied on representation or warranty of <br /> the City not expressly included in the Contract Documents. <br /> D. The information provided bythe Cityis not intended to be a substitute for, or a <br /> supplement to, the independent verification by the Bidder to the extent such <br /> independent investigation of the Drawings and Specifications or Site conditions <br /> is deemed necessary or desirable by the Bidder. Bidder acknowledges that they <br /> have not relied upon City or Project Manager furnished information regarding site <br /> conditions in preparing and submitting a Bid. <br /> 1.5 INTERPRETATION OF CONTRACT DOCUMENTS ' <br /> A. Should a Bidder find what is believed to be discrepancies in or omissions from <br /> the Drawings or Specifications, or should the Bidder be in doubt as to their <br /> meaning, Bidder may submit to the City a written request for an interpretation <br /> thereof. The Bidder submitting the request will be responsible for its prompt <br /> delivery. Any interpretation of the documents, if made, will be made only by <br /> addendum duly issued.
