INFORMATION FOR DEVELOPER: <br />The following information is provided for the developer's benefit. These are not SEPA conditions but are <br />associated with other laws or requirements. All requirements are preliminary in nature, and are based upon <br />the preliminary site plan and the ordinances In effect at time of submittal for SEPA review. The proposal must <br />comply with all ordinances in effect at the time a complete building permit application is filed, including <br />those not specifically set forth herein. Contact the Community, Planning and Economic Development <br />Department for information regarding appeals processes for the requirements listed in this document. <br />Planning— Kelsey Heyd — 425.257.8731 <br />1. Parking is prohibited on the western half of the site, labeled "future phase 2" on the site plan, until the <br />applicant has obtained applicable development permits and Improved the area to meet city standards. <br />2. Performance regulations: Section 39.140 of the City of Everett Zoning Code regulates light, glares, odor <br />and air emissions, and vibration and concussion. Lighting on the building and property shall be directed <br />downward and shielded so as not to create glare impacts on the residential properties to the west. <br />3. Noise: Noise must comply with the City of Everett Noise Ordinance, EMC 20.08. <br />4. Landscaping: Landscape Category C applies except as modified and conditioned via REVI18-034. <br />Landscape Category C requires a minimum 15-foot wide landscape strip with Type III landscaping <br />between the parking lot and Railway Avenue. Internal parking lot landscaping shall be provided per EMC <br />19.34.120.0 and EMC 19.35.080. Approximately 4,710 square feet of internal parking lot landscaping <br />Including 26 trees, is required. A landscape and irrigation plan meeting the requirements of EMC <br />19.35.100 and EMC 19.35.115 Is required to be submitted with the construction permit applications <br />(Building Permit and/or Public Works Permit applications). <br />5. Building setbacks: A 10-foot building setback is required from the west (rear) lot line. No building <br />setbacks are required from all other lot lines. <br />6. Building height: The maximum allowable building height is 80 feet. <br />7. Parking: Off-street parking must be provided per Chapter 34 of the city of Everett Zoning Code and the <br />City Design and Construction Standards and Specifications. <br />8. Signage: Sign Category C applies to the site. See EMC 19.36 for sign regulations. <br />9. Floodplain: Under the applicable FEMA map dated September 16, 2005 (Map ##53061C1035F), a small <br />portion of the proposed development is within the 100-year floodplain. Per Planning Director <br />Interpretation No. 2011-1, compensation must be provided for any effects to floodwater storage and fish <br />habitat function within the 100-year floodplain. A mitigation plan is required and shall include <br />compensation measures. The minimum habitat mitigation requirement is .1 acre of mitigation for each 1 <br />acre impacted by the proposed project. <br />10. An 80-foot utility and public access easement is located along the west lot line. The access road within <br />this easement is shown as an alternative route in the Shoreline Access Plan if the public access trail along <br />the Snohomish River is not constructed. This access road should remain open. The drainage swale along <br />the railroad tracks may require a Critical Area study if proposed to be modified. <br />11. Screening. Section 41.100 of the City of Everett Zoning Code requires screening of outdoor uses and <br />storage areas. A solid sight -obscuring fence and/or vegetation is required around the outside edges of <br />areas devoted to outdoor activity or storage. <br />12. Comply with the recommended Best Management Practices on Pages 8 and 9 of the Biological <br />Assessment prepared by Grette Associates, LLC, dated August 2018. <br />13. Regarding the handling and storage of fuel, chemicals, oil, debris and other substances, the applicant <br />shall maintain, and be prepared to implement, operational procedures to prevent and handle potential <br />spills.
