47. The right-of-way dedication is required along the entire project frontage and shall be 35ft from the <br />existing property line. <br />48. Northbound and southbound lanes for Railway Ave shall be constructed at a width of 12ft. <br />49. On the west side of the roadway improvements, a 6.5ft curb and sidewalk shall be constructed with <br />storm drainage conveyance along the gutter. <br />50. The proposed sidewalk shall comply with accessibility standards and City of Everett Standards current <br />at the time of construction. <br />51. The proposed road shall be crowned at the east end of the road to allow for future roadway <br />expansion with future development. <br />52. All passenger vehicle parking on -site shall comply with City of Everett Design and Construction <br />Standards and Specifications for Development. <br />53. The contractor installing the public roadway shall abide by the recommendations for the <br />development of the public roadway, found in Section 3.5.2 of the 2009 Aspect Consulting Preliminary <br />Geotechnical Report. <br />54. Special charges for connection to the sewer and water systems in accordance with Ordinance 3095- <br />08 (codified as EMC 14.08.135) and subsequent revision are applicable. These charges are based on <br />projected water usage and can be substantial. Applicant is encouraged to obtain a copy of the <br />Ordinance and determine estimated charges prior to building permit application. The actual charges <br />shall be computed by the Public Works Department per the ordinance in effect at the time and <br />according to the information on the approved plans at the time of building permit Issuance. <br />55. The BLA map and site plans for construction shall be updated to reflect the east road as Railway Ave <br />and the west road as an unnamed private paved drive. All references to the "utility easement" should <br />be updated to include the encumbrance of "public access" and should read, "public access and utility <br />easement per A.F.N. 200512225239". <br />56. The applicant has not submitted an independent geotechnical report to support this application, but <br />is instead relying on a preliminary geotechnical study prepared for the City in 2009 by Aspect <br />Consulting. Per Section 1.1.1 of the preliminary study, the City's objectives were "to gain a general, <br />planning -level understanding of the geotechnical conditions that could affect site development". <br />The report raised many concerns regarding the highly variable — and often unsuitable — nature of the <br />near surface and deeper soils present on the site, and indicated special design and/or construction <br />methods might be necessary during the earthwork phase of the project and to ensure the long-term <br />performance of site improvements, including Utilities and Roads/Pavements. Section 1.1.1 of the <br />preliminary study also noted that "[f)urther geotechnical study will be necessary for the design and <br />construction of specific development and design concepts." The applicant shall provide this addition <br />geotechnical study as part of the process to obtain construction permits and the earthwork and <br />proposed design and construction of City infrastructure must demonstrate adequate consideration of <br />all applicable geotechnical Information available. Per EMC 19.37.030, the City reserves the right to <br />hire, at the applicant's expense, an independent geotechnical engineer of the City's choosing to <br />review the proposed scope of any further additional geotechnical study and to review and approve <br />proposed design and construction of City infrastructure, as well as provide inspection services to the <br />City related to the earthwork and construction associated with the proposed "public" facilities, <br />Including construction of the roadway and accompanying infrastructure. <br />57.
