Setback.A nonconforming building certification (NCB18-015)was previously <br /> issued for this property and certified the nonconforming setback of the accessory building and <br /> nonconforming lot coverage.Although the NCB certified the nonconforming setback of the structure, <br /> voluntary demolition of a residential accessory building and rebuilding is subject to the provisions of <br /> EMC 19.38.030.C. Per subsection C.2.a, a new accessory structure may be built in the same location <br /> provided "the new structure does not exceed fifteen feet in height within the setback..."The accessory <br /> building as proposed cannot be approved in its current location because it exceeds 15' in height within <br /> the required 5' side setback. Please revise the site plan accordingly, demonstrating compliance with <br /> these setback provisions or alternatively, reduce the height of the structure within the 5' setback <br /> requirement to 15' or less and update the plan sets <br /> The garage has been shifted north so it is now located outside the 5'setback. The footprint is the <br /> same. The wall between the wood shed and alcove has been shifted.
