� ( �. <br /> (h) The above ground utility or communications facility shall be removed from <br /> the site should the use for such purposes be discontinued for one hundred <br /> twerty days or more. <br /> (i) Maintenance, repair, or replacement of existing utility or communications <br /> facilities or appurtenant structures and the installation of minor above <br /> ground utility and cornmur�ications facilities of a minor nature and small <br /> scale are exempt from this, section. <br /> Q) To the extent provided by law, the City may require utility or <br /> communications service provider to allow up to two additional service <br /> providers to be located on shared facilfties to discourage the prolfferation <br /> of tower structures, consistent wRh technological feasibility. <br /> (k) Communications facilities which require towers forwhich safety lights a�e <br /> required by the FAA shall not be pertnitted unless the Applicant <br /> demonstrates that such a facility in the proposed location and at such a <br /> height is necessary to aclequately serve the needs of the public for the <br /> proposed utility or communications service. <br /> (I) The Planning Director may require review by an expert third oarty when <br /> needed for review of site-spec�c data submitted by the Applicant <br /> conceming technical aspects related to specific facilities and locations. <br /> 18. No tower structures will be built. The antennas wiil be placed on a PUD pole, <br /> eliminating any new cellular communication tower or monopole. (exhibit 1) <br /> 19. The Applicant did consider altemate sites because the demands that have been <br /> created with the increaspd use in this location of the City. Any altemate sites <br /> would be outside the proposed service area. (exhibit 1) <br /> 20. Because of the technology involved, the utility pole and the antennas cannot be <br /> underground. The support equipment wili be located on grade within a cabinet. <br /> (exhibit 1) <br /> 21. Sixty-three feet is the minimum height necessary for the proposed facil'ity in order <br /> to provide the service to this portion of the City �f Everett. (Spencer testimony) <br /> 22. The Applicant testified that its equipment wouid be removed if there were any <br /> financial failures of the company. The facility would also be removed ff the use <br /> was discontinued for 120 days or more. (exhibits 1 & 3) <br /> 23. Because of the location of the PUD pole, the facility is not a potential site for <br /> collocation of other communication facilities. The Applicant has collocated with <br /> the PUD. (exhi6it 1) <br /> 24. No lights are proposed for this pole. (exhibit 1) <br /> � <br />
