(exhibit 1) <br />� . <br /> Jurisdlction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hcaring and to issue the decision. That authority is set forth in EMC 2.23.120. <br /> Based on the above Findings of Fact, the Hearing Examiner enters fhe following <br /> Concicrsions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approvai of a Special Property Use Permit for an above <br /> ground communications facility to be located within a residential zone at 8401 <br /> Holly Drive, Everett,Washington. The proposal includes placement of a 63-foot <br /> high Snohomish County PUD utility pole on City right-of-way. Three panel <br /> antennas will be placed on the top of the pole. Four cabinets would be installed <br /> within an equipment compound on private property located near the util'ity pole. <br /> (finding 1) <br /> 2. The General Evaluation criteria for Special Property Use Permits in the City of <br /> Everett have bPen identified in finding #4. The proposal satisfies these criteria in <br /> the manner as set forth findings 5- 16. <br /> 3. The Specific Evaluation criteria for poles as set forth EMC 19.41.150.D.1(b) have I', <br /> been identified in finding#17. These criteria are satisified pursuant to findings <br /> 18 -25. <br /> DECISION <br /> Based uoon the preceding Findings of Fact and Conclusions, testimony and zvidence <br /> submitted at the public hearing, and upon the impression of the Hearing Examiner at a <br /> site view, it is hereby ordered that a Special Property Use Permit for the installation of <br /> an above ground communications facility in the public right-of-way at 8401 Holly Drive, <br /> Everett,Washington, is granted. The Applicant may place a 6�-foot high utility pole in <br /> the Gity right-of-way with three panel antennas being placed at the top of the pole. In <br /> addition, up to four cabinets can be installed within an equipment compound on the <br /> adjoining property that is operated by a church. These pertnfts are granted subject to <br /> the following conditions: <br /> 1. The Applicant shall provide a landscaped strip that is a minimum of ten feet in <br /> width with Type III landscaping from the north edge af the wetland to the s�uth <br /> edge of the parking lot. <br /> 2. The Applicant shall enclose the equipme�t compound with a soiid wood fence. <br /> 3.
