4. Since the comprehensive plan was adopted in 1994, the voters of the Puget Sound <br /> have established the Regional Transit Authority to provide regional transit service, <br /> and 19th Avenue SE has been designated as a regional bus corridor by the RTA plan. <br /> 5. The proposed increase in housing capacity will offset some of the losses in housing <br /> capacity in the Everett Planning Area caused by previous land use map amendments <br /> including the amendments for Everett Community College, M & M Associates; and <br /> other amendments included in the 1997 update to the comprehensive plan, including <br /> the Aurdal and Bumpass land use map amendments. <br /> 6. The applicant proposes to develop a high quality multiple family development. Use <br /> of the Resolution of Intent to Rezone process with limitations on the number of <br /> dwelling units and making the rezoning of the property contingent upon submittal and <br /> construction of a development plan commensurate in character and quality to that <br /> represented by the applicant shall ensure that the proposed amendment to the land use <br /> map will result in minimal land use impact upon surrounding single family zoned <br /> properties. <br /> 7. The proposed land use designation promotes a desirable land use pattern along the <br /> 19th Avenue SE Medium Intensity Mixed Use Corridor, and is in the best long term <br /> interests of the Everett community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The land use designation of the Land Use Map of the Everett Comprehensive <br /> Plan for the JPI Properties, Inc., property, located on the southeast corner of 19th Avenue <br /> SE and 116th Street SE, as depicted on the attached"Exhibit A, Map #1," as adopted by <br /> Ordinance#2021-94, is hereby amended from 1.3 "Single Family Detached, 10 to 12 <br /> Dwellings per Gross Acre"to 1.6 "Multiple Family, 20 to 29 Dwellings per Gross <br /> Acre." The land use designation shall be implemented through a Resolution of Intent to <br /> Rezone. <br /> Section 2. That should any section, subsection, paragraph, sentence clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br />
