• <br /> Such a permit may be revoked by the Health Officer <br /> upon the violation by the holder of any of the terms of this <br /> ordinance, or at any time when in the judgment of the Health <br /> Officer the restaurant or bakery has become a public health <br /> menace , provided that the holder of said permit shall, after <br /> complying with such revocation, have the right of appeal to the <br /> Board of Health. <br /> Section 3. Application for Permit - Any person desir- <br /> ing to maintain and operate a restaurant or bakery in the City of <br /> Everett shall first make written application to the Health Officer <br /> for a permit therefor, setting forth the name of such persons and <br /> the location thereof . The Health Officer shall thereupon cause <br /> such place with all the fixtures end appliances connected there- <br /> with, or to be used therein, to be carefully inspected and if said <br /> applicant shall have fully complied with the provisions of this <br /> ordinance the said Health Officer shall issue a written or <br /> printed permit to such applicant in accordance therewith. <br /> Section 4. Examination and Condemnation of <br /> Unwholesome Adulterated or Misbranded Food or Drink. <br /> Samples of food and drink may be taken and examined by <br /> the Health Officer as often as he deems necessary for the detection, <br /> of unwholesomeness , adulteration or misbranding. The Health <br /> Officer may condemn, remove and destroy any food or drink which <br /> he deems unwholesome, adulterated or misbranded. <br /> Section 5. Sanitation Requirements - <br /> All restaurants and bakeries must comply with the <br /> following items of sanitation; <br /> Item 1. Floors - The floors of all rooms in which <br /> food or drink is stored, prepared or served, or in which utensils <br /> are washed shall be of such construction as to be easily cleaned, <br /> shell be smooth and shall be kept clean and in good repair. <br /> Kitchen floors shall be impervious to water. <br /> Satisfactory Compliance - This item shall be deemed to <br /> have been satisfied: <br /> (1) When the floors of all rooms in which food or drink <br /> is stored , prepared or served are of such construction as to be <br /> easily cleaned are smooth and are in good repair. Floors may be <br /> of concrete , terazzo, tile , etc. , or wood covered with linoleum <br /> or tight wood floors. <br /> (2) j,4hen the floors of all rooms in which food is <br /> prepared or utensils are washed are constructed of concrete, <br /> tile or other impervious material or tight wood floors in good <br /> repair and provided with drains . However, where floors of such <br /> rooms are kept clean without flushing a linoleum or similarly <br /> impervious surfacing in good repair shall be accepted in lieu <br /> thereof and the drain requirement shall be waived. If floor <br /> drains are used they shall be provided with proper traps so <br /> constructed as to minimize clogging. <br /> -2- <br />
