3.b(4) The location of utilities within residentially zoned areas shall be planned to <br /> protect the residential neighborhoods adjoining the areas from unnecessary impacts <br /> associated with facility development. <br /> 4.b(4) Utility facilities shall be designed, constructed and used in a manner which <br /> minimizes visual incompatibility with adjacent land uses and other laws and codes. <br /> Implementation <br /> 2. Utilities constructed in residential neighborhoods shall be designed and constructed in a <br /> manner consistent with the character of the area. Where actual design of a structure <br /> cannot be modified (e.g., above ground vaults, power poles, etc.), appropriate <br /> buffer/screening measures shall be required as a condition of development. <br /> 3. When possible, the City shall minimize encroachment on view and solar access of existing <br /> residences by new utility facility construction or improvement. <br /> and; <br /> WHEREAS,the Urban Design Element of the City of Everett Growth Management <br /> Comprehensive Plan contains the following policies concerning "gateway corridors" which are <br /> relevant to the siting of"above ground utility and communications facilities:" <br /> 1. The following arterials and highways are designated as "gateways corridors" for <br /> which particular attention will be given to the design and maintenance of public <br /> improvements and the application of standards to development of abutting <br /> properties: <br /> Broadway north of 41st Street, West Marine View Drive, Pacific Avenue, Hewitt <br /> Avenue, Everett Avenue, Rucker Avenue between 19th Street and 43rd Street, <br /> Colby Avenue, Mukilteo Boulevard, 41st Street, Evergreen Way, 19th Avenue <br /> SE, 128th- 132nd Street corridor, SR 526, and Interstate 5. <br /> 6. The design of sites, buildings, landscaping and signs which are developed on <br /> properties abutting the designated gateway corridors should be of a quality that <br /> upgrades and enhances the aesthetic character of the City in general and the <br /> immediate area in particular. <br /> WHEREAS,the Growth Management Act requires the City's development regulations to be <br /> consistent with the policies of the Comprehensive Plan; and <br /> WHEREAS, the City desires to comply with Section 714 of the federal Telecommunications Act <br /> of 1996 by allowing for the reasonable accommodation of personal wireless service facilities <br /> while implementing the policies of the Comprehensive Plan, providing for the general health, <br /> safety and welfare of the public, protecting property values and minimizing visual impacts. <br /> 2 <br />
