($5000.00) and the mutual covenants herein expressed, it is hereby agreed for the use <br />and benefit of said parties that: <br />1. For and in Consideration of the sum certain agreed to in the memorandum of an <br />easement of Grantor Parcel A to Grantee Parcel B and the construction of a residential <br />development designed and developed by Todd Rosholt on Parcel B. Parcel A (Valley <br />Baptist Church -Everett, a non-profit Corporation) enters into this Easement & <br />Maintenance Agreement with Parcel B (Todd Rosholt). <br />The purpose of this agreement is to extend all existing easement rights by or on <br />behalf of Parcel A in existence regarding the Sanitary Sewer shown in Exhibit A, a map <br />of the 788 sq. ft Sanitary Sewer on Parcel A legally described in Exhibit B - Sanitary <br />Sewer Easement. The cost of the recording of this agreement covering the execution of <br />its covenants, promises and express conditions shall be the sole financial responsibility <br />of Parcel B. The Easement and Maintenance Agreement is the sole and complete <br />understanding of the parties and is not revocable or modifiable in any part or portion <br />with out the signed written agreement and acknowledgment before a Notary. <br />2. Parcel A hereby grants perpetual and unlimited ingress, egress, access for the <br />connection construction, installation, maintenance, repair, replacement of the <br />connection to the Sanitary Sewer on Parcel A. Parcel A and its assigns and successors <br />hereby agree to accommodate and to cooperate with Parcel B and its enployees, <br />contractors, utility suppliers, personnel and equipment operators in connecting to and <br />maintaining the connection to the Sanitary Sewer. <br />3. Parcel A also grants a perpetual easement appurtenant to Parcel B and it <br />occupants, successors, assigns and licensees for access for ingress and egress to connect <br />to and to maintain the connection to the Sanitary Sewer described in Exhibits A& B <br />attached to this easement agreement. Parcel A is hereby granting and conveying a non <br />exclusive easement over and across those portions of Parcel A's parcel reasonably <br />necessary for the construction, repairing, maintaining inspecting, and operating of the <br />connection to the Sanitary Sewer. This grant is reciprocal and Parcel A retains a <br />perpetual easement for ingress and egress for any and all uses granted to Parcel B <br />regarding the Sanitary Sewer located on Parcel A. <br />4. Location of said easement is legally described in Exhibit B and shown in the <br />Easement Map Exhibit A. <br />5. Parcel B agrees to pay for any and all costs associated with connecting to the <br />Sanitary Sewer described in Exhibits A and B and to restore the pavement, the ground <br />and surrounding area to the same or better condition of the easement surface prior to <br />Party B connecting to the sanitary sewer. Parcel B shall at all times follow existing <br />statutes, ordinances regulations and rules associated with the connection to the Sanitary <br />Sewer on Parcel A. <br />6. Parcel B shall promptly pay all costs, expenses, permits, expenses and items <br />associated with the connection to and the maintenance of the connection to the Sanitary <br />Sewer. Parcel B has no legal right or permission to place any lien or cost associated <br />with the connection to the Sanitary Sewer on Parcel A. Furthermore, Parcel B shall <br />
