Seattle, Washington <br /> Aril 3, , 1939 <br /> City Council of the City of Everett <br /> Everett, Washington <br /> Gentlemen: <br /> North Coast Transportation Company hereby surrenders to the <br /> City of Everett all rights and privileges now held by said company <br /> under any and every franchise heretofore granted by the city of <br /> Everett, or by the County Commissioners of Snohomish County, to <br /> maintain street railway tracks and to operate street cars there— <br /> over and to maintain and operate an electric interurban railway <br /> upon and along any of the streets, avenues or other public places <br /> within said cit., and also surrenders to the city of Everett all <br /> street and interurban railway tracks now owned by said company <br /> which are located in any of the streets' avenues or other public <br /> places of said city, including all of the ties, rails and track <br /> accessories. <br /> Without limiting the generality of the foregoing, the follow— <br /> ing franchises are specifically referred to: <br /> Franchise granted to Edward P. Burch by Ordinance No. <br /> 252 of the City of Everett, passed on December 3, 1900, <br /> as amended by Ordinance No. 2037 passed on August 15, <br /> 1922; <br /> Franchise granted to Pacific Northwest Traction Company <br /> by Ordinance No. 2036, passed on August 15, 1922. <br /> North Coast Transportation Company further offers to pay the <br /> sum of $16,963.49 for a full release from all obligations of every <br /> kind, except as below stated, arising out of or under said franchises <br /> or any of em, and in particular for a full release from the obliga— <br /> tion to remove said tracks upon abandonment of street railway and <br /> interurban operations and to repave the streets after such track <br /> removal, such release to extend to and be for the benefit of Puget <br /> Sound Power & Light Company, as well as North Coast Transportation <br /> Company, and also all of the predecessors in interest and succes— <br /> sors and assigns of each thereof including Everett Bus System, <br /> Inc., as the present holder of the franchise granted by Ordinnce <br /> No. 2037. <br /> It is understood that all rights granted by said Ordinance <br /> No. 2037, heretofore transferred to Everett Bus System, Inc., <br /> shall remain unaffected by this surrender or by said release, <br /> except that upon payment of said sum by North Coast Transportation <br /> Company the holder of said franchise, its successors and assigns, <br /> shall likewise be deemed fully released, as above stated, from the <br /> obligation to remove tracks upon abandonment of street railway <br /> operations and to repave the streets after such track removal. <br /> Yours respectfully, <br /> NORTH COAST TRANSPORTATION COMPANY <br /> Vice—President <br /> — ti — <br />
