November 28, 2018, Award Request for Proposals# 2018-048 for Primary Public Defense Services to Everett Law Association Defense Services Fund: Fund 003 Indigent Defense Program Fiscal summary statement: The City spends approximately $1,200,000 per year on primary indigent defense services. Everett Law Association has agreed to hold its pricing in exchange for a five-year contract renewal. Project summary statement: Individuals charged with misdemeanors and gross misdemeanors in the City of Everett are arraigned in Everett Municipal Court. The vast majority of defendants cannot afford an attorney and qualify as "indigent" under state guidelines. The City is required by state and federal law to provide these indigent defendants with legal representation at the City's expense. The City's main indigent defense provider, Everett Law Association, provides most of that representation. The City's current contract with Everett Law Association is a five-year contract from 2018-2023. The proposed amendment extends the contract for an additional five years, until 2028, and provides that the City may terminate the contract before then if the City decides to conduct another Request for Proposal process, as it did in 2018. The proposed amendment does not change contract compensation. Recommendation (exact action requested of Council): Authorize the Mayor to sign Amendment 1 to the Agreement for Indigent Defense Services with Everett Law Association for a five-year extension term in the estimated amount of $1,200,000 annually.
