AMENDMENT NO. 1
TO AGREEMENT FOR INDIGENT DEFENSE SERVICES
BETWEEN THE CITY OF EVERETT
AND EVERETT LAW ASSOCIATION
This Amendment No. 1 to Agreement for Indigent Defense Services (this
"Amendment") is dated as of the date of last signature below. It is by and between the
City of Everett, a municipal corporation under the laws of the State of Washington ("City")
and Everett Law Association ("Public Defender").
RECITALS
A. The City and Public Defender are parties to the Agreement for Indigent
Defense Services dated November 8, 2018 (the "Agreement"). All capitalized terms in
this Amendment are as defined in the Agreement. Under the Agreement, the Public
Defender provides indigent defense services in connection with the Everett Municipal
Court.
B. The term of the Agreement is January 1, 2019, to December 31, 2023. The
purpose of this Amendment is to extend the Agreement for five additional years, so that
the term of the Agreement will end on December 31, 2028. This Amendment also makes
other changes.
AGREEMENT
The City and Public Defender agree as follows:
1. The Agreement is modified to extend the Agreement for five years, so that the term
of the Agreement ends December 31, 2028.
2. If the City determines to issue an RFP for indigent defense services, the City may
terminate this Agreement upon one year's prior written notice to Public Defender,
which notice will state the effective date of termination. The effective date of
termination may not be before December 31, 2024. This termination right is in
addition to any other termination right that may exist in the Agreement.
3. The following are added to Section 1 of the Agreement:
1.9 Effective January 1, 2024, Public Defender shall accept all
discovery in electronic form via email or via other electronic means.
1.10 Effective July 1, 2023, Public Defender shall schedule all interviews
(including telephonic interviews) with Everett police officers during
the officer's regularly scheduled shift.
4. Effective January 1, 2024, Section 1.7 is deleted from the Agreement. This means
Public Defender will no longer be required to have a principal court liaison as of
that date.
1
