4. Visual Matching: Where matching an established sample is required, the <br /> Architect's decision will be final on whether a proposed product matches <br /> satisfactorily. <br /> a. Where there is no product available within the specified product category which <br /> matches satisfactorily, and also complies with other specified requirements, <br /> the contractor shall comply with the provisions of the Contract Documents <br /> concerning substitutions for the selection of a matching product in another <br /> product category. <br /> 5. Visual Selection: Where specified product requirements include the phrase "...as <br /> selected from the manufacturer's standard colors, patterns, textures..." or similar <br /> phrases, select a product and manufacturer that complies with other specified <br /> requirements. Architect will select the color, patterns and texture from the product <br /> line selected. <br /> 1.5 PRODUCT SUBSTITUTION <br /> A. General: <br /> 1. No substitution request will be considered unless submitted in accordance with <br /> the requirements of this Section. <br /> 2. If a bidder or Contractor desires approval of some material or product other than <br /> that specified by the Contract Documents, it must submit a written request for <br /> approval of the proposed substitute item to the Architect in accordance with the <br /> following requirements: <br /> a. All requests must be made on the Owner's Substitution Request Form. <br /> b. After receipt of bid, substitution requests shall be prepared, transmitted, <br /> and processed in accordance with Section 01 33 00 "Submittal Procedures." <br /> 3. Final decision as to whether an item is an equal or acceptable substitution rests solely <br /> with the Architect and Owner. <br /> B. Substitution Requests: Every substitution request must state whether the item offered <br /> is equal or superior to the specified product. The substitute material or product must <br /> be accompanied by its reference in the Contract Documents and complete catalog, <br /> technical and other information. If applicable, include samples showing comparison of <br /> physical and other pertinent characteristics as required to establish equivalence of <br /> acceptability for the proposed application.Where specific test results are required by the <br /> Contract Documents, the comparison data for the proposed item shall be based upon <br /> the same test methods as those specified, or they shall be correlated to clearly <br /> demonstrate comparability. The same warranty of the Work described for the specified <br /> product is required for the substitution. <br /> C. During Bid Period: <br /> 1. Submit the Substitution Request Form prior to the date identified in Section 00 23 <br /> 13 "Instructions to Bidders" that is included with the bid package. <br /> 2. Bidders will be notified by addendum of products accepted in addition to those <br /> specified.
