E. BIM Coordinated Shop Drawings: <br /> 1. General: BIM (Building Information Modeling) shall be implemented in the coordination <br /> of this Project, per the documentation requirements of"Closeout Procedures" Section <br /> 01 77 00, 1.2 Project Record. The building information model will originate from the <br /> Architect and will be a shared resource during the design and construction of the <br /> Project. <br /> 2. Indemnification of Owner, Architect and its Consultants: <br /> a. The Contractor and any Subcontractors receiving BIM information and/or electronic <br /> files shall execute the Architect's Consent for the Release of Electronic Media form, <br /> as applicable, prior to release of information. Contractor shall be responsible for <br /> getting executed forms from their Subcontractors and providing to the Owner and <br /> Architect. Any requirements of the Architect's Consent for the Release of Electronic <br /> Media form are supplementary to the information provided herein. <br /> 1) Digital Data Licensing Agreement—AIA Document C106 <br /> b. The BIM information and/or electronic files are provided by the Owner and the <br /> Architect to the Contractor as a convenience and shall not be considered "Contract <br /> Documents", "Construction Documents", "Drawings of Record" or in any other way <br /> the Contractual Instruments of Service. <br /> c. The Contractor and their Subcontractors, in receiving the BIM information and/or <br /> electronic files from the Owner and Architect, agrees to indemnify and hold harmless <br /> the Owner, Architect and its Consultants, to the fullest extent permitted by law, from <br /> any damage, liability or cost, including reasonable attorney's fees and cost of <br /> defense arising from any reuse or modifications of the BIM information and/or <br /> electronic media by the Contractor or their Subcontractors or any entity who <br /> acquires or obtains the electronic media from or through the Contractor. In no event <br /> shall the Owner, Architect or its Consultants be liable for any loss of profit or <br /> damages resulting from use. <br /> d. The Owner, Architect and its Consultants make no warranties, either expressed or <br /> otherwise implied, of the merchantability and fitness of the BIM information and/or <br /> electronic files for any particular purpose. <br /> e. BIM information and/or electronic files are recognized to be subject to alteration, <br /> degradation, erosion and erasure. The Contractor and their Subcontractors are <br /> advised to check all electronic media for computer viruses before loading the files. <br /> The Contractor and their Subcontractors receiving files, agree to indemnify and hold <br /> harmless the Owner, Architect and its Consultants against all claims of any kind put <br /> forth by the Contractor, their Subcontractors or any other recipients as a result of <br /> inadvertent viruses transmitted with the electronic files. <br /> f. Information provided by the Owner, Architect and its Consultants is for specific use <br /> on this project only and is not to be used for any other purposes. BIM Execution <br /> Plan to be developed by Architect, Owner and GC/CM.
