Upon request,Construction Manager shall provide the Owner with supporting documentation from its insurer and <br /> surety of any associated cost incurred.Construction Manager is not entitled to any increased premium on any retainage <br /> bond as such bonds are optional. If the Construction Manager performs Work as a Subcontractor(i.e.on a package on <br /> which the Construction Manager was the low Subcontractor-bidder),the Construction Manager shall be paid the Fee as <br /> provided in Section 7.5.6 of the A201 but shall not have the above Fee percentage applied to such Changed Work <br /> • 6.1.5 Rental rates for Construction Manager-owned equipment shall not exceed the rates identified in Section 7.5.2 <br /> § 6.1.6 Liquidated damages,if any,shall be established in the GMP Amendment. <br /> § 6.1.7 Other: <br /> (Insert provisions for bonus, cost savings or other incentives, if any, that might result in a change to the Contract Sum.) <br /> There are no shared savings provisions;all savings shall revert to the Owner. <br /> §6.1.8 The Specified General Conditions are in the fixed amount of One Million Two Hundred Thirty Eight Thousand <br /> Seyen Hundred Forty Five Dollars($ 1,238,754.00)based on the level of staffing and project duration known at the <br /> time of fee proposal submission. The final Specified General Conditions sum shall be negotiated based on the level of <br /> staffmg and duration of service required for Construction Manager's management staff The weekly unit rates are <br /> quoted in the Fee Proposal and Preconstruction Cost Proposal Form. <br /> §6.1.9 The allowance for Negotiated Support Services will be negotiated at the time of establishing the MACC. <br /> § 6.2 Guaranteed Maximum Price <br /> The Construction Manager guarantees that the Contract Sum shall not exceed the Guaranteed Maximum Price set forth <br /> in the Guaranteed Maximum Price Amendment,as it is amended from time to time. To the extent the Cost of the Work, <br /> Negotiated Support Services,Specified General Conditions,the Construction Manager's Contingency,plus the <br /> Construction Manager's Fee exceeds the Guaranteed Maximum Price,the Construction Manager shall bear such costs <br /> in excess of the Guaranteed Maximum Price without reimbursement or additional compensation from the Owner. <br /> § 6.3 Changes in the Work <br /> § 6.3.1 The Owner may,without invalidating the Contract,order changes in the Work within the general scope of the <br /> Contract consisting of additions,deletions or other revisions.The Owner shall issue such changes in writing. The <br /> Construction Manager may be entitled to an equitable adjustment in the Contract Time as a result of changes in the <br /> Work. <br /> § 6.3.1.1 The Architect or Owner may order minor changes in the Work as provided in Article 7 of AIA Document <br /> A201-2017,General Conditions of the Contract for Construction. <br /> § 6.3.2 Adjustments to the Guaranteed Maximum Price on account of changes in the Work subsequent to the execution <br /> of the Guaranteed Maximum Price Amendment may be determined by any of the methods listed in Article 7 of AIA <br /> Document A201-2017,General Conditions of the Contract for Construction. <br /> § 6.3.3 In calculating adjustments to subcontracts(except those awarded with the Owner's prior consent on the basis of <br /> cost plus a fee),the terms"cost"and"fee"as used in Section 7.3.3.3 of the revised General Conditions and the term <br /> "costs"as used in Section 7.3.7 of the revised General Conditions shall have the meanings assigned to them in Section <br /> 7.5 of the revised General Conditions and shall not be modified by Sections 6.1 and 6.2, Sections 7.1 through 7.6,and <br /> Section 7.9 of this Agreement.Adjustments to subcontracts awarded with the Owner's prior consent on the basis of cost <br /> plus a fee shall be calculated in accordance with the terms of those subcontracts and the Contract Documents. <br /> § 6.3.4 In calculating adjustments to the Guaranteed Maximum Price,the terms"cost"and"costs"as used in Article 7 <br /> of AIA Document A201-2017 shall mean the Cost of the Work as defined in Article 7 of this Agreement and the term <br /> "fee"shall mean the Construction Manager's Fee as defined in Section 6.1.2 of this Agreement. <br /> § 6.3.5 If no specific provision is made in Section 6.1.3 for adjustment of the Construction Manager's Fee in the case of <br /> changes in the Work,or if the extent of such changes is such,in the aggregate,that application of the adjustment <br /> provisions of Section 6.1.3 will cause substantial inequity to the Owner or Construction Manager,the Construction <br /> AIA Document A133' - 2019.
