AN ORDINANCE providing for the improvement of Oakes Avenue from 13th Street to 16th Street by grading to proper grade, construction of concrete curbs and construction of Six inch Portland cement concrete pavement Thirty (30) feet wide , installation of necessary drainage, and doing all other work necessary to make a complete improvement; creating an assessment district ; creating a local improvement district fund therefor; providing that the cost of the improvement, not to exceed r`ifty-five percent ( 555) , plus fixed estimate , be paid by special assessment upon the property in said district under the mode of payment by bonds, and the balance thereof shall be paid from funds a:Llocated to the City of Everett by federal grant from the united States U-overnment under PWA, end declaring an emergency. WHEREAS, a petition of the property owners petitioning for said improvement has heretofore been filed with the City Council, and WHEREAS, said petition was signed by the owners of Sixty percent (60%) of the lineal frontage upon the improvement to be made and three-fourths of tie area within the limits of the proposed improvement district , and said petition specified that such proposed improvement district may be assessed an amount up to double the assessed valuation, exclusive of improvements thereon, and the said City Council has examined said petition and has found the things set forth therein to be true ; and WHEREAS, the said petition has been referred to the Commissioner of Fublic '.:orks to be examined by the said Commissioner and the City Engineer, and the Commissioner of Public ..orks has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public -.corks has recomigended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience and necessity require such improvement be made ; and 'a:IIEREAS, a grant from the united States Government of Forty-five percent (455) of the cost of said improvement has been received, and the contract documents are awaiting for bid preparation. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Oakes Avenue from 13th Street to 16th Street be improved by grading to proper grade, construction of concrete curbs and construction of Six inch Portland cement concrete pavement Thirty (30 ) feet wide , installation of necessary drainage and doing all work necessary to make a complete improvement, all in accordance with the plans and specifications prepared under the direction
