1 <br /> <br />Memorandum of Understanding Between the City of Everett and <br />the Evergreen Arboretum and Gardens <br /> <br /> <br />1. General. This Memorandum of Understanding (MOU) describes <br />how the Evergreen Arboretum and Gardens, a Washington non- <br />profit corporation (the “Arboretum Society”), will complete a <br />project as described in Section 2 below at the Evergreen <br />Arboretum & Gardens in American Legion Memorial Park, <br />Everett Washington. The City of Everett (“City”) will not make <br />provide any financial contribution or payment to the Arboretum <br />Society towards the Project. <br />2. Project. The Project is as follows: <br />A complete renovation of the Backyard Garden at the <br />Evergreen Arboretum, an area of approximately 9,800 <br />square feet, to return it to an inspirational and <br />educational part of the Arboretum. The Project is <br />anticipated to include a 200 square foot concrete patio <br />designed to look like a crosscut tree stump -- complete <br />with a bark-like edge, a sensory mound, dry stream bed, <br />a more meadow-like lawn area, improved paths, as well <br />as new trees and shrubs. The renovated garden will be <br />designed to ensure year-round interest by incorporating <br />trees, shrubs, and perennials that provide color, <br />structure, and scent throughout the seasons. <br />3. Basic Project Requirements. <br />A. The Project is at the sole cost of the Arboretum Society. <br />The Arboretum Society represents that it has secured full <br />funding for the Project. <br />B. No work on Project may start until after the City’s Director <br />of Parks and Facilities or designee has approved all <br />contractors, specifications, plans and schedules for the <br />Project. The approved plans, specifications, and schedules <br />are referred to in this MOU as the “Approved Construction <br />Documents.” <br />C. The Arboretum Society and its contractors will complete the <br />Project in accordance with the Approved Construction <br />Documents.
