2 <br /> <br />D. The Arboretum Society is solely responsible for compliance <br />with the terms and conditions of any grants the Arboretum <br />Society is using for the Project. <br />4. Public Park. American Legion Memorial Park is a public park. <br />Regardless of any other provision of this MOU, the City may at <br />any time and at the City’s sole discretion move or eliminate any <br />or all of the Project. <br />4. Volunteer and Paid Labor. <br />A. Prior to working on the Project, each volunteer worker must <br />sign a Waiver and Release on forms provided by the City. <br />B. The Arboretum Society must give notice to the City prior <br />to any use of paid labor on the Project, unless that labor <br />is paid by a contractor (in which case, see Section 5 <br />below). All workers and laborers who are paid for Project <br />work must be paid an amount not less than the prevailing <br />rate of wages established for each trade or occupation as <br />established by the Washington Department of Labor and <br />Industries, in accordance with Chapter 39.12 RCW <br />(Prevailing Wages). This will require filings (intents and <br />affidavits) with the Washington Department of Labor and <br />Industries. The City may also require each worker and <br />laborer to sign a Waiver and Release on forms provided by <br />the City. <br />5. Contractors. The City grants permission for contractors of the <br />Arboretum Society to enter City property and complete the Project, <br />subject to the following: <br />A. The City must approve the contractor before the contractor <br />begins any work. City <br />B. Before a contractor begins work, the Arboretum Society <br />must provide the City with a complete fully-executed copy of <br />the Project contract between the Arboretum Society and the <br />Contractor. This contract must include a fully executed <br />addendum in the form required by the City. Among other <br />things, the addendum requires the contractor to pay all <br />workers, laborers, or mechanics employed in the <br />performance of any part of such work an amount not less <br />than the prevailing rate of wages established for each trade <br />or occupation as established by the Washington Department <br />of Labor and Industries, in accordance with Chapter 39.12
