. 2 ORDINANCE NO. 2688. AN ORDIdA3'CE providing for the licensing and regulation of machines used for playing games of skill for commercial purposes; prohibiting minors from playing thereon; providing penalties for the violation thereof, and declaring an emergency. THE CITY OF EVERETT DOES ORDAIN: Section 1 : It shall be unlawful for any person, firm or corporation to operate within the City of Everett, Washington, any game of skill without first obtaining a license therefor in accordance with the provisions of this ordinance. Section 2: A game of skill as used in this ordinance shall mean and include all games involving an element of skill capable of being played or operated with, or upon any mechanical device or machine of any kind, nature or description in the playing or operation of which a player may be entitled to receive, whether automatically or otherwise , any merchandise awards, or any right to further operate said machine or device. Section 3: Any person, firm or corporation desiring to maintain, keep or operate any such game of skill , as herein defined, shall make written application for license so to do and file the same with the City Clerk of the City of Everett, who shall thereupon present the same to the Commissioner of Safety of the City of Everett for his approval or rejection, and such application shall state the name of the applicant, and address and glace of business at which any of said machines shall be maintained or operated, a description of such game and the serial numn3er of such machine or device for which license is applied for, and the total number of such games desired to be covered by the license. Upon the approval of any such application by the Commissioner of Safety he shall present said application to the City Council of the City of Everett, and upon the approval of said application and the payment of the fee therefor, as herein provided, the City Clerk of the City of Everett shall issue to said applicant a license to operate said machines or devices for which license has been applied. Section 4: Each license shall be issued for a period of one month. The monthly license fee for each machine or device shall be the sum of Five dollars (::.: 5.00) per month, payable in advance , and shall be issued for each particular machine device licensed. No license shall be transferred or from one machine or device to another, and no machine or device which is licensed shall be transferred from one location to another. -1-
