. <br /> 2 <br /> ORDINANCE NO. 2688. <br /> AN ORDIdA3'CE providing for the licensing and regulation <br /> of machines used for playing games of skill for commercial <br /> purposes; prohibiting minors from playing thereon; providing <br /> penalties for the violation thereof, and declaring an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : It shall be unlawful for any person, firm <br /> or corporation to operate within the City of Everett, Washington, <br /> any game of skill without first obtaining a license therefor <br /> in accordance with the provisions of this ordinance. <br /> Section 2: A game of skill as used in this ordinance <br /> shall mean and include all games involving an element of skill <br /> capable of being played or operated with, or upon any mechanical <br /> device or machine of any kind, nature or description in the <br /> playing or operation of which a player may be entitled to <br /> receive, whether automatically or otherwise , any merchandise <br /> awards, or any right to further operate said machine or device. <br /> Section 3: Any person, firm or corporation desiring <br /> to maintain, keep or operate any such game of skill , as herein <br /> defined, shall make written application for license so to do <br /> and file the same with the City Clerk of the City of Everett, <br /> who shall thereupon present the same to the Commissioner of <br /> Safety of the City of Everett for his approval or rejection, <br /> and such application shall state the name of the applicant, <br /> and address and glace of business at which any of said machines <br /> shall be maintained or operated, a description of such game <br /> and the serial numn3er of such machine or device for which <br /> license is applied for, and the total number of such games <br /> desired to be covered by the license. <br /> Upon the approval of any such application by the Commissioner <br /> of Safety he shall present said application to the City Council <br /> of the City of Everett, and upon the approval of said application <br /> and the payment of the fee therefor, as herein provided, the <br /> City Clerk of the City of Everett shall issue to said applicant <br /> a license to operate said machines or devices for which license <br /> has been applied. <br /> Section 4: Each license shall be issued for a period <br /> of one month. The monthly license fee for each machine or <br /> device shall be the sum of Five dollars (::.: 5.00) per month, <br /> payable in advance , and shall be issued for each particular <br /> machine device licensed. No license shall be transferred <br /> or <br /> from one machine or device to another, and no machine or <br /> device which is licensed shall be transferred from one location <br /> to another. <br /> -1- <br />
